Just got back from a GN job
I showed the signer the two certificates and asked her which one she wanted. She chose an ack. Next thing I know, she asks me, can't you just stamp on the document? Everytime I've ever had a notarization, that's what they do! I shudder to thoink how many notaries are out there just stamping a document without the notarial wording.

that is exactly what prompted this document from our SOS(below)......and a statement in our notary brochure....they actually sent this document to people when they were first getting their commissions or renewing for a couple of years. Im not sure if they are still sending it or not. I had personally done some complaining on this to our SOS as I had heard and seen over and over again of notaries in Wisconsin doing this.

I've had it happen - some friends asked me to notarize something a couple of years ago, and there was no notarial certificate on the document. When I pointed this out, the wife got upset and said "They just want you to stamp it!"
I wouldn't do it; they eventually found another notary who would.

This is the main reason I hate GNW - people always telling me how to do my job. There have been several times they just refuse to accept a loose leaf - they claim all the receiving agency wants is my stamp on their doc with none of that superfluous ack/jurat verbiage. One time a guy wanted my stamp on his passport; then he was going to copy that and send it off to some foreign country as proof of something. I told him he needed to sign something and I needed to have some notarial wording. He got mad and refused ... and he was a CA notary! He said he did this all the time for his buddies.

I've never experienced this kind of problem... but if I did, I'd just whip out the handbook where it says, "...a notary public seal and signature cannot be affixed to a document without the correct notarial wording."
If they still didn't agree, then I would tell them I'm not going to risk fines or jail for breaking the law, it's just that simple. People are always shocked to hear that a CA notary can land in jail - specifically for forgery or perjury.

One of the major reasons you always always always...
...collect fees for general notary work in advance. People tend to be much more compliant when they realize they're going to have to pay twice to get the document notarized.

I rarely have THAT happen but it has. When it does, I show them what is correct and what is incorrect. It's hard for even an adnormal person to say, "give me the incorrect one". If they do, I just tell them NO!

To the original poster, it is possible that the person was used to have the ack/jurat language already on the form at the bottom and it "seem" as if it was just stamped. As to the other posters, that is just crazy.

I have a small stamp just for those occasions, I have to hand print the venue. If there is room on the doc, if not I use preprinted certificates.

I love the idea of a pre-printed acknowledgement or jurat stamp. I've seen that mentioned here before. If I did a lot of GN work, I may get one. When I do GN work, I'd say ~10% of the documents do not have notarial wording. And, yes, people do not like the attachment. I have never had anyone turn and run!

Hi, Sha/CA
My experience is they HATE the ack/jurat stamp even worse than an attachment. They don't want anything messin' up their document with stuff they don't understand - which is just about everything we do.
Incidentally, I haven't seen the ack stamp for years. I bought mine ages ago from the largely defunct gomobile or whatever its name was .. along with a jurat stamp (with room for 1 name or 2 short names), which I can't live without for loan signings. About a year ago I wanted to get an ack stamp for another notary and talked to someone at the NR store who said they don't carry it here because of problems. (I think because the stamp can be so iffy - there's ALOT of verbiage to shrink into 2x4 inches and if you don't press it just right on the document, you get too much ink in one area and not enough in another). I did get a CA compliant jurat stamp here with room for 2 names.

I'd like to have one made. Is there a minimun type size required? 6pt, 8pt?

I wouldn't think so...
The jurat stamps come the way they come - whatever pt size that is. As far as the acks, I think you could get it made any pt size you wanted, keeping in mind you probably would never use it on a Deed of Trust, (I never have) because I think there are pt size requirements among the county recorders. I use it on all other loan docs that are nonrecorded and that have noncompliant CA wording. I have been doing this for years - both the ak and jurat stamps - and have never had any problems .....

I did a "re-do" on a DPOA yesterday
First notary notarized with lots of empty blanks on the form. Bank rejected it, told them to call me. 10 copies were signed, sealed and delivered for $110 X 2. They said they were going to contact notary #1 for a refund. I wonder if they'll get it?

FYI: ACK/Jurat Stamp
Can be made (at least here in FL) at the local Office Depot, in one day. Cost was about $45.
