Brokers Choice Title - Willoghby,Ohio
I am done with Brokers Choice Title out of Willoghby, Ohio. I did some signings for them last year and still have not been paid. I have been calling and Faxing and emailing for the past three months and have received nothing but lies and excuses. I called today and got a smart-alec reply when I asked if the person who answered was Sal (the "owner"). I simply stated that I needed to get paid and he hung up on me.
I have entered them in Signing Central, with the lowest rating possible - for the lowest possible form of life on the earth. I will do so on all other Notary sites as well. If he ever pays me I will remove or retract these comments.
I have not been paid. What I stated here is the truth. Did I hold back too much?

Find out which state entity is in charge of licensing them in Ohio (Dept. of Insurance?) and send a letter of complaint that the company has failed to fulfill its contractual obligations in regards to a real estate transaction that they collected money from the borrowers for. You may have to look up who the registered agent is and file a complaint against him/her. Also, find out who their bond is held with and file a claim against it.

If it's taken you this long to be paid why retract?
It remains the truth that it took you that long to get paid - I wouldn't retract, just update that payment was FINALLY received...

Yikes! This is awful. TCs in CA are regulared by the Dept. of Insurance and so I would immediately be contacting them about these miscreants, but I don't know if Ohio is the same way. Was the notary fee on the HUD? Are they not dispersing funds according to regulations? If they are a true TC they must be regulated by some Big Dog state agency that you could let know you are being cheated .... also I would be notifying the lender/broker/ Realtor and everybody else I could think of ...

I went through my files and I notice that all the loans were with the same Mortgage company (also in Ohio, different city) so I will contact them. Thank Goodness that I keep a copy of the first page of every HUD! The Secretary of State handles Notary Commissions here in Ohio, I'm not sure who regulates Title companies unless it is the same. Thank you for the suggestions all!

Before you go making noise, make sure to check and see if the security instrument for the loans you closed did, in fact, record. At least then you know the loan funded. If something happened and the loans didn't fund you may be out depending on your prior agreement with the company.

Got it! I found the site and called to make sure they regulated Title Companies. The fellow on the phone assured me that they did and directed me through the site until I was on the right page, which is:

Great. DOI even has its own complaint form! You could consider filling out the form but not filing it. Print a copy and send it to these bums with one last-ditch effort to get paid, saying you will file it if payment is not immediately forthcoming. Also let them know you will be forced to contact everyone involved in the transaction, etc etc. and see if you can scare them into paying you. Also do what Linda said: check the county recorder's site to make sure the loan funded and title was recorded. That way you'll know exactly what you're talking about in your letter. If it didn't fund, you're entitled to a print and trip fee, unless they told you unfront they don't pay for that ....
