Signature certification/affidavit question

I get some that have same name on top and bottom sections. Do you apply your seal to both? I have been doing that but, also notice that the bottom one will say error!reference source not found but, then there is the name on that signature line.

What lender is it for? The Chase ones require borrower to sign both top and bottom, and notarization on both top and bottom. I have not seen any that said, " error!reference source not found".

Yes, it is for that lender. This one does have that error in the bottom portion but, has name on signature line. I had them sign at both.

Yes, Chase requires borrower signature on the top and bottom, and notarization on the top and bottom.

The one that says error in the bottom portion is the title companies version of Chase's form and you will also see Chase's form included with their doc's, right after the RTC forms. I usually line out error, have the borrower write their name above it, initial next to the line out and sign below. Yes they would sign both ways on both portions together with any additional aka's on the bottom portion, just the same as on the Chase form.

I have done a bunch for Chase and if the bottom part of the form is blank I leave it blank. I do not have Bo sign bottom, and no notarization on the bottom.

I have not had any calls to say I've done it wrong....

Can we hear from others?? Do you fill ot thebottom if blank??

I haven't done any of those recently, but if memory serves, the bottom part only applies if there are additional AKAs - I think. At least I recall that there are some situations where the bottom part may not need to be completed, so you have to actually read the document. It should be clear what is or is not required. Most of the time, I've done both, but I have had some where the borrower didn't need to sign the bottom section, so there was nothing to notarize on that section. And yes, I left it blank.

All of the Chase ones I have done have always had at least one name listed on the bottom, which is the same name the borrower has been listed as throughout the entire loan package. Sometimes there will be an additional name or two, but always at least one name listed at the bottom (in my experience). I do Chase for LSI and they include an instruction page which states that both top and bottom MUST be completed and notarized.

I probably do more Chase closings that any other lender lately and have 3 or 4 different title companies that send them to me. Lately, all of them have included instructions which require both the top portion and the bottom portion of that form must be completed, even if there are no aka's.

As to the form that shows "error!reference source not found", I have only had that form with one company and I believe it is only if they did not fill out the form correctly prior to sending out the doc's. It is the title company's version of the Chase form, not the actual Chase form and with this TC, they are both included in the package. The other title companies only include the Chase form in the package. The title company form has jurat's included and the Chase form has acknowledgement's included.
