commission expires on 5/11/11
I didn't get a change to renew my commission and the next available Notary Exam classes that I can go to is on 6/18/11. This is my first time to renew my commission. What's the rule about this as there will be a time lapse before I can take the exam... Do I need to delivery all the notarial supplies/records to the county? Would appreciate a response to this query. Thank you.

I don't believe you have to turn anything in to the County Clerk. That's only when you resign your commission. Obviously, you won't be able to do any notary work after 5-11-11. With your earliest class being on 6-18-11 I would say you are going to have a fairly long lapse in being able to do notarizations again. It seems to be taking around 8-12 weeks after taking the exam, having your background checked and the SOS sending your new commission.

Why don't you do an online class?
Otherwise, you might as well sign up for some temp work. If you put your commission renewal on the back burner, you obviously don't depend upon this for a living!

unless you're planning to take the test and the class on the same day (which might not be a bad idea...) you're biggest problem will be getting signed up for a proctored exam. Otherwise, like Shoshanna said, you could do an online class (like the one offered here) and start right away. Be sure to read up on all the other things you'll need to do, and in what order. It'll help to have your ducks in a row. Good luck!

Yes, you will have to file you journal with the county clerk
You are required to do so within thirty days of your commission expiring. Let's be honest - there is no way you will get a new commission by June 11. You will have to submit your journal to the county clerk where your oath is filed.

You might use "IMO". This is CA law, not FL law. n/m

Woops..too quick..
And there's no "IMO" about it - it's in black and white.

I WAS talking about CA law, and what I stated was
not an opinion, it was a fact.

Do you mind sharing the "fact"? Perhaps I am doing something wrong.

Sure, directly from page 10 of your handbook
Within 30 days from the date the notary public commission is no longer valid, the notary public must deliver all notarial journals, records and papers to the county clerk’s office where the oath is on file. If the notary public willfully fails or refuses to do so, the notary public is guilty of a misdemeanor, and shall be personally liable for damages to any person injured by that action or inaction. (Government Code section 8209) Any notarial journals, records and papers delivered to the Secretary of State will be returned to the sender.

My commission expires 6/9/2011 I took the test in Feb, got notice of passing March 7...I have heard nothing since and waiting anxiously....Definitely I will not be turning in ANYTHING as I expect to be re-appointed since nothing has changed in my life that would cause me to not be re-appointed. Other states might have different rules but in California, that it.....!

Notarysigner, you should receive everything in the mail any day now. They will not send it out until 30 days prior to your commission expiring.

2011 CA SOS Manual page 30, paragraph 8209, reads:
"If any notary public resigns, is disqualified, removed from office, or allows his or her appointment to expire without obtaining reappointment within 30 days, all notarial records and papers shall be delivered within 30 days to the clerk of the county in which the notary public's current official oath of office is on file.
There is more including being found guilty of a misdemeanor and liability.
Not hard to find if you have read your manual more than once.

course & exam on 5/18/11
thank you all for your comments.
I might be able to take the course & exam on 5/18/11 - would I still need to deliver all notarial supplies to the county? I am expecting to pass the exam. If my new commission does not arrive prior to the 30 day window, would I still need to deliver all notarial supplies to the county?
