Give up the 80 bucks, send certified letter giving a due date for payment and what you will do if payment is not made by date on letter. Once date has arrived (give 7-10 days) and no check you go to local PD and file Theft of Service charges and a warrant will be issued to the owner of the company.

If you go this route you cannot collect money due if you file a criminal charge.

If you want 80 bucks that bad, go to small claims court in and maybe you will get money and fees one day.

I go with plan A and have always been paid when that certified letter goes out.

If anybody on this forum has ever been successful in having a prosecuting attorney file theft of services charges in a business-to-business transaction, I would appreciate you posting the details, including the case number.

In the meantime, I would suggest that other signing agents proceed quite cautiously in pursuing such a remedy, whether you can find a prosecuting attorney who will do it, or whether you actually file the charges yourself, as some jurisdictions permit in criminal matters.

I do not know of any jurisdiction where a citizen would go to the police station to file criminal charges; normally you would go to the police to file a complaint, who then, if they felt it justified, would file charges. A citizen would go to a court or to a prosecuting attorney to file charges.

Tread cautiously when following advice you get off NotRot if that advice could result in someone being arrested. The ramifications to your wellbeing could give you permanent indigestion.

Just give me the case number for any case in which theft of services charges in a business-to-business transaction were filed by any New Jersey prosecutor. Especially show me a case involving a signing agent and his/her fee.

For the benefit of everybody you have suggested file criminal charges, let me point out the dangers in what you have recommended:

Assume for a minute you can get a public prosecutor to file such a charge. The commission of a crime requires intent; you have to intend to hurt somebody, or enter someone's house unlawfully, or steal someone's money. Sometimes, your negligence can be so great as to result in implied intent, but whatever the source, intent is crucial in a criminal case.

Is it criminal for a business to say that someone has taken up so much of the business's time that the cost of the time used exceeds the amount owed, or that the damage to the business's reputation by critical comments is far greater than the amount owed? Any prosecutor foolish enough to take on such a case is probably not smart enough to win it. And where does that leave you, the fellow who filed the original complaint? Looking at a false arrest lawsuit or a misuse of process action.

Think long and hard before getting involved in the criminal justice system. Odds are, you will live to regret it.

NJ is not that big a state

How far away are you? I once told Frank I would be by to pick up my check the following week if I did not have it in the mail by Friday. It worked. It was also the last time I worked for Speedy. I was a lot more hungry in those days than these. I suppose he counts on that.

Linda, $80 is way too low for a loan closing. Companies that pay this low are usually trouble.
