I just received a letter from the Indiana BK Court about this company filing for Chapter 7 bankruptcy. They listed me as a creditor ($100 for a job in April of 2009), but I was actually paid by them, so their record keeping may have been part of the problem. I'm sure many of you were stung by this. Since what we do in unsecured, many folks are taking it on the chin. Too bad E&O insurance doesn't protect us getting paid. Does any know of insurance that could protect us if we get stiffed?

That's a good one. Best practice is to only work for 3.5 stars and above. The rest is a crap shoot. Not like farmers who get paid not to farm their land (government subsidized)...we're out there like itinerant merchants.

was individual only...companies are Chapter 11.

Possible he filed individually only - maybe you can still pursue the company.

He filed a chapter 7. However he listed all his clients (us) as unsecured debts. R&R was probably not an LLC, just a sole proprietor small business. I do BK's for several attorneys, so I have a PACER account and I downloaded his petition. The notice states NOT to file a Proof of Claim at this time because he shows no redeemable assets. If anyone would like to know if they are listed on his schedule F, just email me. He has 92 pages on his creditor matrix.

I'm reviewing the bankruptcy as I have pending litigation against them. It is a personal bankruptcy which is worthless as their company owes the money. The company, R and R Group, L.L.C. did NOT file bankruptcy. He still has to pay and my case moves forward.

Sure..the company didn't file and can do a Chapter 11

and reorganize, stay in business and keep on rolling - absent, of course, the debts to all those unpaid notaries they're trying to discharge under their personal BK.

R&R never paid its notaries anyway, so I don't see how this is going to make any difference ...
