The most important documents - Loan Signings

Hello! I am a beginner NSA. What are the most important parts of loan package? I know Note, Deed, Trust in Lending, Right to cancel, estimated closing statement. What are the other important ones? Thank you"!!!!!!!!!!!!!!!!!!!!

To those involved ALL the documents are important. It is not your call to decide the importance of a particular document. They ALL must be signed, dated, or initialed, and some sworn to and notarized, and the entire signed package returned in a timely manner, as per your instructions. Without all the documents properly executed the transaction will not be completed. Your job it to get everything signed/dated/initialed as instructed, and to witness the signatures. It’s easy… but there is NO room for errors. NONE!
You will find that the MOST IMPORTANT documents are the ones you made a mistake on, or didn't get properly signed or notarized. JMO

It will help to learn the correct form names........

You can avoid some problems and confusion by learning the correct names of the forms, as normally printed across their tops. Rather than "Trust In Lending," it is "Truth In Lending." Rather than the "estimated closing statement," what we normally see is the "final closing statement," showing the numbers as they are at the time of the signing, which are intended and believed to be correct and final. It is more commonly titled on the form as the Settlement Statement or HUD-1. Some of those you mentioned are part of what are sometimes called the "critical" docs. When a title company or signing service mentions "critical" docs, such as when they tell me to fax the critical docs after the signing, I ask them to please specify exactly which forms they want faxed, for sometimes it's not exactly the same forms I think they'll specify. Yes, they are all important, and you'll get familiar by studying them intently and frequently.

and do not do that Tuesday signing. You are putting the borrowers at risk by your lack of knowledge. Please don't attempt signings until you're very familiar with your state notary laws and have had training in loan signings!

Dimitri has been blinded by the big bucks...

...he can make as a signing agent. He's gotten a whole $50, and all he has to do for it is to watch while somebody signs some papers. It's like finding a bird's nest on the ground.

when you ask a question like that, exposing your absence of knowlege of loan signings, you will get slammed.

Note that I didn't say lack of knowlege, I said absence of knowlege. So you ask the veterans here to train you. Are you looking for the easy way out, or some free training?

Suck it up mister 4 languages and put the time and effort in to study and learn.

Actually, the estimated closing statement and the final

closing statement are two different things. The estimated closing statement comes out of CA.

You guys are a bunch of ***. I just asked for help because I will sign for my relatives loan on Tuesday. I don't want to do this for my career. I already learned how to do signings.

By the way, I specialize in certified translations (fluent in 4 languages) and make around $80-$90 per translating one simple document such as Birth Certificate (15 minute work)

I think I have the picture now, Dimitri

You are a notary public with no experience in loan closings. Your inlaws have a loan that needs closing. To save them the fee of a signing agent, to earn the agent's fee yourself, you have persuaded them you can do the closing. Then you come to Notary Rotary for instruction on how to close a loan, in hopes of taking away a fee from one of the very people from whom you are asking advice. When you are uniformly told by the experienced signing agents who post here that you are unqualified, you trash them and their profession.

You don't place a premium on class, do you, Dimitri?

Depends on who it is - you can't notarize for

spouse, father, mother, sister, brother - doesn't say anything about relatives farther removed than that. I don't think it's a good idea but I'm not so sure it's precluded.

Here's what I wonder...

My husband's brother is a step brother - so kids are step nieces and nephews - we almost never see them as they live over 2 hours from us..

Wonder if I could notarize for brother-in-law and his kids since I would have absolutely NO interested in anything he does. (No interest in notarizing for him either but that's another story..LOL) Just curious about a situation like that.

Tell your "relatives" that you don't do loan docs but you CAN do notarizations - tell them to pull the docs requiring notarization to the top and you'll take care of those for them but you can't go through the package because you don't do loans.

I'm sure as relatives they'll understand that..

IMPO you've lost any possible credibility and I, for one, don't believe it's for relatives - I think you took a job and now don't know what to do with it so you want this forum to bail your butt out while you shoot at us for stating the truth.

And I, for one, don't appreciate your name-calling when you're told the truth - you're making a mistake doing closing. Suck it up, admit to it, and tell them you can't do it - you'll be doing everyone a favor.

My sympathies to the borrowers if it doesn't fund, or the delay resulting from his errors causes them to lose their rate lock.

The thing that amazes me so much about you, Dimitri, (with the accent on Dim) is your appalling sense of entitlement. Your Nov. 9 post was similar to going on to a physicians chat board and saying, "Yikes! I have to perform brain surgery Tuesday morning. Give me some tips. I've never done it before." Now you return, saying that so far you've discovered that the important parts of this type surgery are the brain, the skull, the anesthesia and a nurse.

Almost as appalling was your continued emphasis on wanting all this information "cheap" and quick. Finally, you insult those on this board, all of whom have given you excellent advice, by not saying "Thanks" but only managing to sputter out "Ass." What class (with the emphasis on ass).

Speaking of brains, if you had any, you would have taken this weekend to perhaps think outside the box since you have emergency "surgery" right around the corner. You could have, for example, randomly called a few LOs, or a few EOs or even a few nearby NSAs and offered to pay them "handsomly" (not "reasonably" as was you first offer, aka cheap) to spend the weekend going over sample loan packages and sample title docs with you in an effort to avoid complete meltdown Tuesday.

Lastly, if you read the heading at the top of this board, it says "Serving Professional Notaries Public Nationwide" (with an emphasis on Professional). Clearly, you don't belong here.

Let's see... I knew more about being a signing agent, having never done a signing, then you will know after a thousand signings.

I am one of 17 notary educators approved in Florida... do you even know how to administer an oath? Take an acknowledgment?

I've been an expert witness in six court cases on notary law... have you ever read a book on notary law? Have you ever read your state's notary laws in their entirety? Have you ever read your handbook? Do you realize that there IS a handbook? Or did you just buy the book that the NNA sold to you as part of your oh-so-revered NSA certification?

I *AM* a professional... not a check-cashing clerk that likes to play notary once in a while.
I belong on this board, you do not. I know how to spell "loser", you do not.

I *KNOW* the limits of the notary profession. I know that the market can not handle much more signing agents. You, against the advice of the members on this board - many of whom have been signing agents for many, many years - apparently know better than us. You go girl.


Don't come crying when you fall on your face or wind up the subject of a lawsuit.

From reading the thread, it was Dimitri that made the remark "LOSERS" after receiving the proper advice from 4 veteran NSA's. He continued his verbal assault throughout the rest of this thread. The others, unfortunately, responded in kind, but he brought it upon himself. No one went after him first.
