avidavit of amendment of mortgage

I got a call telling me the date had been left off a mortgage ( 1 1/2 yrs ago) and that I need to go back to the borrowerw and have them sign an affidavit stating they did sign it in front of me on that date. The company also wants me to go to the courthouse and record this document. Opinions desired, this will cost me at least 2 1/2 hrs, 120 miles what would you charge for something like this.

For one piece of paper??? I'd tell them

send it to someone closer or send it directly to the mortgagors and have them get a notary near them...they can go to their bank, a UPS store, a pack n ship or do a computer search.

I won't travel 120 for a full loan signing, never mind one piece of paper. That's insane.

But that's just me and MHO..

Sorry, to answer your question

if they insist *I* do it - 2.5 hours - 120 miles (is that one way or round trip?) - $150+ - for one piece of paper they can get done for the cost of a FedEx or UPS airbill.

Re: Sorry, to answer your question

Was this date something that you did not fill in?

Why are they concerned about a date from over a year ago? Are you sure you were the notary? And what date do they want put on it?

I agree with Linda. It's less expensive for everyone if the caller sends the doc to the signer and has them handle it. I would not get involved at this point.

Did they send you a copy of the original mortgage?

That would be the first thing I would want to see.

Re: Did they send you a copy of the original mortgage?

They did not send me a copy of the original mortgage...I would like to see it. They told me a date had been left off but I received the affidavit today and it states the borrowers are certifying that their signatures were witnessed and notarized by me on the "date so indicated on the above described mortgage" after I get the signatures I'm to take it to the county courthouse for recording. ( Never done that before!) I got the mileage wrong it will be about 75 miles round trip and they have said they will compensate me. I was the notary at the closing. I am going to do it as I live in a rural area and am used to travelling ( usually out into the boonies) I just need an idea of what to charge, I got $125 for the closing.

Re: Did they send you a copy of the original mortgage?

I would look up notaries to see who was near by and then ref "whoever". Do you know how much it cost to record Docs? You'd have to include that in you fee unless you recorded them the first time.

To answer your question, $150.00

"..."date so indicated on the above described mortgage" is

the red flag to me.

If you did not get the *original* doc with signature page and Notarization, how can anyone attest to anything?

Describing a doc is *not* producing a doc.

No doc = no re-do, no matter the price.

Also, no upfront $$$ to record, no dice.

First, I'd ask them to send me a copy of the last page with

your notarial certificate. How could you have done that without a date? Otherwise, if it was your error, it should really be on your dime. If not, I'd start the negotiations by asking what they were willing to pay & go from there. I don't think I'd do it for less than $100. It would make much more sense to send it to the borrowers, have them get a notary, and ship it back. It sounds like they want you involved since you had done the original signing & were the one that saw them sign on that date.

It sounds to me like the borrower's are just signing an aff. saying that they did indeed sign a mortgage on ... Let them sign it and notarize their signature. If it says that they signed it before you on a specific date, then I would check my old journal to make sure that they did indeed sign one before you on that date. You cannot notarize a document known by you to be false.
I wouldn't need to see an original.

Oops, your question was about what to charge.
Personally, I would charge the per signature charge allowed by my state and then add for the travel and recording fees. You're in the "boonies" so I would assume that you've already figured out what an acceptable fee would be for the travel.

If it was due to a missing date in the notary block (that you did not fill in the date), then you should do it at no charge. BUT....they need to send you a scanned copy of your notarized page.

If it was on the first page or any other page of the document, then charge a full fee of around $150. IMHO.

Also, I would check your journal to verify that they did sign the documents on that date. I was once asked to backdate a mortgage to the day before. When I refused to do it, the owner of a signing service took out my notarial page of the mortgage and inserted his own and notarized it with the back date. He then signed his name on the signature page as a witness to their signature. (Wisconsin is not a witness state).

Back to the original question, I would charge at least $150 if not my mistake.
