I posted last week that he is out of biz, and noted that
in Signing Central. Another notary has posted that the lender was taking responsibility for payments to notaries. I don't know about that. I've called & sent emails to them--no response.

The bankruptcy thing sounds good but I think we all had better be careful. It just sounds like this guy may find another hole to crawl through and start using a different name or company. I just don't think he is the type of person to go out of business and then you never hear from him again. I'll bet that someone on this forum eventually will discover him doing business under another name or company.

No they can't continued doing business Linda. But once you've been notified by them that a bankruptcy has been filed you can't even send them a bill and it stops all suits to collect debts here in Florida. Different states have different bankruptcy rules. Many move to Florida to file because of the homestead exemption and it's easier to file.

Forgot to add. A bankruptcy stays on your credit for 10 years if you file in FL, not the usual 7 years, because of the lower requirements & exemptions.

Keeping in mind that bankruptcy rules are federal
In a Chapter 11 bankruptcy, which is a business reorganization filed when the business cannot meeet it's credit liabilities, the debtor can retain the business as a "debtor in possession" - so the business CAN continue to operate.

I was just referring to a general Chapter 7 bankruptcy Linda. OP didn't state type at all, ran into many filing bankruptcy while serving papers for creditors, had to write down B# and leave, wasn't allowed to serve papers at all even on Chapter 13's.

Just another reminder...
When posting this kind of info, it's very helpful to put the name of the ss (or whatever) in the subject line. Many of us skip around when reading posts and it's impossible to get to everything, so having that info there is very useful when deciding what to read. I think it might also help with searches on a particular company. (Linking to Signing Central is also a very good thing.)

Trying to get in touch with him? Good Luck! He doesn't answer the phones or respond to e-mails. I had 2 signings the same weekend for him. New American Funding did pay my fee for one but the other title co. has responded but nothing yet. I bet he will resurface at some point as Angelic Services! LOL

I haven't had any response from New American Funding.
I'm guessing that if Paul files bankruptcy, they won't have any recourse to collect from him. I think you were very fortunate to get your money.
