Affidavit of Heirship . . .

(Alias "Airship" for those that got a laugh on me recently!!). I have a signing tomorrow for the affidavit mentioned on the Subject line - the person said the typed verbiage in the doc relates to her mother's real property. The also wants to include the mother's vehicle in the affidavit so she WROTE IN the mother's vehicle info as well and asked me if that would fly. I, of course, said I can't give legal advice but would ask if anyone knew an answer that I COULD give her.

IMO she needs to ask whoever prepared the doc

or whoever is in charge of her mother's estate, or possibly the probate court - many here can speculate but we really can't give a truly definitive answer that you should rely on - unless there's an OR attorney somewhere in the audience..Smile

I'm in 100% agreement with you. She did tell me that she didn't want the expense of an attorney. Said she had a co-worker that helped her fill out the paper work! She may be OK with this as in nothing ventured, nothing gained. Not sure. I've personally never had to deal with this kind of stuff before so it's all foreign to me! Thanks for your reply Linda.

That's funny! Her helpful addition to the Airship dock won't fly. But it won't crash either.

I'm guessing that this is a small estate probate or an ancillary probate (the main probate could be in another state). These Affidavits of Heirship help a court to clear title to a piece of real property. A court will probably look at the addition of the personal property (the vehicle) and say "interesting, but irrelevant." . . . but that's all just my guess. I'm not licensed to practice law in Oregon.

It was pretty funny, an education, and humility all rolled up into one! You are right on Rani, the mother did live in another state. I will pass on to her what you said - good reply. Thanks!
