Back Dating
I recently moved from Ca to Va. Got my commission and have been doing okay even though I lost 90% of my clientele being they are on the west coast. I have read the Va notary handbook and don't see what I am looking for. Could have missed something. But a title company called Genuine Title out of Maryland is asking me to backdate. I advised them that it was against the law for me to backdate. It sounds like they are trying to find another notary who will backdate to do the job...which is fine with me....but I want to be sure that backdating is illegal in Va....as I believe it is everywhere. Did I miss something in all of my training or is Va different.....thanks.

Wow! The signing central information regarding Genuine Title says it all. Phew. Guess I am glad they asked me to do something illegal and I told them no. Thank you fellow associates

Molly, regarding your search of the VA notary handbook for backdating references, I suggest you read the VA ack form. Does is say, for example, "on such and such a date, so and so appeared before me"? That would seem to rule out backdating. Actually, I think the VA ack says "the foregoing instrument was acknowledged before me on such and such date," which also would seem to preclude backdating.
As far as reporting this incident, unless you got something in writing asking you to date your notarial certificates for another day, it would be their word against yours. Did they send you anything? Like the name of the borrower and property address? If so, you could follow up at the county recorders to see if they actually got a notary to backdate and then report the notary and the TC.

Completely dishonest and fraudulent to backdate, no matter what state you are commissioned in. They have a lot of nerve. Perhaps they are on the skids...It's not at all in your best interest to Backdate no matter what they say or how much $ you are offered to do this.

Also Molly, Genuine Title WILL call you again. I suggest you utilize caller ID and log them in your phone address book as "NO! Genuine Title" so next time they call you, you can just ignore the call when they pop up on caller ID.

I concur that back dating is a total no. I appreciate all of your input...it just reaffirmed what I knew....it is amazing that so many companies think it is okay to ask the notary to back date. I haven't heard back from them so they were obviously successful in obtaining a notary who would do what they asked. Better them than me....I like having my notary commission and I like to obey the laws. Seems like a no brainer to me.

Nothing different here--backdating isn't legal anywhere.
I've found it's always a "red flag" when cos. request it. You probably dodged the bullet on this one & already found out the poor payment rep of the co. BTW, welcome to Virginia. It's very different from the West Coast, but I think you'll grow to love it here. I came to VA from PA, and have been very happy. :-)
