NCLG / Debt Mitigation / Notary Pro
NP (3 stars) called and offered me this assignment....I was working a Harvest Festival and couldn't hear well, but it sounded like a structured settlement, so I agreed to it. Turns out it is debt mitigation for unsecured debt (credit cards, revolving credit, etc). I am not to collect any cash or post-dated checks, etc and it's clearly stated that this is not a loan modification. I haven't read the whole pkg (25ish pages) that I must complete before I'm certified. A law firm handling the negotiations is to pay me directly. Instructions state that I am an employee of them (yet they want me to fill out a W-9) and will be making a sales call. 99-9/10% sure I'm turning this back--I don't do sales; but I was wondering if anyone else had any experience with this and if I do turn it back am I shooting myself in the foot? Assignment isn't until Friday, so I have plenty of time to turn it back to them. G/B/U?

I do debt resalution for a law firm. It's easy and they pay me directly. I'll do it every time they call.

I personally avoid these for many reasons...mostly moral standards.
As you stated, "Instructions state that I am an employee of them (yet they want me to fill out a W-9) and will be making a sales call."
If they are sued, guess which employee will also get sued...may be the employee who met with them and had them sign the docs.
If they are being taken advantage of do you want to be the one face they will probably ever see in the transaction?

I would only do it if you get something in writing from them amending the instructions and stating that you are NOT an employee.

I had a similar request a few months ago from a signing company that I did other work for. I was not comfortable with it as the instructions said that I would be able to answer questions about the program...not true. Plus the fee was less that what this signing company usually paid me.

I turned it back. What Jim said hit home....I try hard to follow the golden rule. Just because something is legal doesn't necessarily make it "right." When I called NP, the agent didn't seem at all surprised. I got the impression that they 'sell' the notary on taking the icky job without going into a lot of detail in the hopes that they will just go ahead and do it, even if they have second thoughts.

I have done 6 of these thru NCLG/Notary Pro.... it takes a long time to get paid. I had to say I wouldnt accept anymore assignments until I got paid for at least one before I got 1 check in the mail.... still waiting for the other 5!

I received a call also after reading the instructions and details I too had to decline. It stated that I was an employee and they did not want me to tell the client that I was a notary (1st red flag). Also I had to pitch to the client, I am NOT a saleperson (2nd flag). Will not print, pitch, fax, and mail documents (by US mail)for $75.00. For a percent of the detail maybe.
