PA notary law

Received docs for a split signing on Wed.. 1st. notary was from PA. She closed for Jane Doe on the 24th, but she printed John Doe's name in the DOT ack. and left his name in all her other acknowledgments and therefore indicating that he was in her presence which obviously he was not. He is here in Miss.. She also left the wording "husband and wife in the acks. She also placed her seal on the ID documents that the wording says "I certify" blah blah blah that has no venue or proper notarial wording, And I called her and she said that that is how she does things and that I could line thru his name on the DOT where she had printed it in her certificate. She kept saying that since he did not sign that it was OK for her to put his name in the certificate. HUH? I have let her know that I will be posting here so that she can see that she might want to study her SOS laws. Is this the way things happen in PA??

I would give the TC a heads up on the problem coming their way. They will have to contact the first notary and arrange to fix her errors. Not your problem.

accordingly. The point of this post was that I could tell that this notary thought I was out of line to question her about the acks and jurats(adding or leaving his name in the certificate when he is not present) and her use of her stamp inappropriately without state compliant wording. And also leaving the wording i.e. husband and wife, or single, etc. in the pre printed acknowledgments, I thought if maybe someone else would shed some light on PA notary law that it would help her in the future if she reads this. She indicated that this is how she has always handled the certificates and use of stamp on the ID documents.

It really is not saying anything (not against you snoop, but against that statement) It makes you want to ask, well how long have you been DOING this?

It's like when someone says "they meet my fee." WHAT is YOUR fee? Could be $25, could be $125...

All I can say is, I hope the person's E&O insurance is up-to-date...and I should add, I hope that I'm never put in a position to have to use mine...(don't wanna be self righteous! We all make mistakes.)

case of not knowing how to fill in the certificate or using ones stamp without proper wording. And then to ask me to line out the name.

Yes, we all make mistakes, absolutely. But this person sounds like she does not even understand what she is doing is wrong. I wonder if this is a $50 "notary"

Oh no, I wasn't insinuating that SHE made a mistake, I was just trying to C.M.A. so as not to create any bad karma by thinking I MYSELF am above making a mistake.

Hopefully this is a learning experience for her and there aren't any negative repercussions from the grave mistakes that were made. It sure is VERY valuable information.

Your better off not contacting the other notary and just notifying the TC of the problem. They always seem to get defensive and really don't listen to what you are telling them.

No, this person clearly does not know what she is talking about. It pains me to hear stories like this of someone who has no business being in this business if they do not even understand the basics of notarizing documents properly. I would hate to see how she handles an actual closing. I hope the TC sees that and does not use her again.
