Death Claims

Ok NoRO Family, Saturday I will do my first notarial siging for a Death Claim-wanna make sure that the appropriate forms is filled out Which should be a Jurat because it is to verify the person signing is stating that they are who they say they are. Was I correct in stating that two witnesses need to be present to sign in addition to the person for whom the Jurat is for?

The signer must make the determination whether ack or jurat is needed if the cert is not part of the doc. You also cannot determine if witnesses are needed or how many.

As Shoshana stated you can not determine whether a jurat or ack is required, or if witnesses are required, but I do suggest that you review the difference between a jurat and acknowledgement. A jurat is not used to "verify the person signing is stating that they are who they say they are".

Your responsibility is to simply execute the appropriate notarization, and as the others have said, which one is appropriate is for someone else to determine. The nature of the document you are notarizing is pretty much irrelevant. You do need to make sure that it's complete (i.e. all filled out), but how it's done is also not your responsibility.

One notarization is pretty much the same as any other. (Slight oversimplification, of course, but pretty much true.)

OOOpppssss! my mistake, i don't have to make that determination it is for the client to know. I also was thinking about credible witnesses & jumped the gun "with know how". I am nervous, because I want to make sure I please customers and this is an opportunity for repeat business. I did take the advice of so of the responses to the first inquiry I had & I am getting a few calls Yippeee. I personally want to thank all of you for your sincere input & slapping me in the face for my ignorance. Smile
