I went to do a closing today. I had asked if they had proper id they said yes. When I got there they presented a maricula card, passport, birth certificate, credit cards everything but, a government issued id. I said no.
What would the rest of you have done?

Well - it depends on what IL identification laws for notaries are, but in CA we are allowed to use foreign passports as long as they have been stamped by the U.S. Can't you?

U,S. Passport ok; foreign passport stamped on entry into U.S. is ok; Illinois Firearms Owners Identification Card, Illinois ID Card, U.S. Armed Forces ID, any State's drivers license all valid in Illinois. Jesse White's website has the handbook and rules. You may have missed a chance by refusing the passport, but you should never do a job if you have doubts.

Did you call title?

This is the card used by non-legal residents, it's issued by the Mexican government.

I'll bet the passport was from Mexico.

Did title know all this? If so then you made the wrong move, if not then you made the right one.

Sdaly, they'll just find another notary to 'stamp-it' and move on.

•Not only does the matricula subvert U.S. immigration law, it is not even a secure identity document. Mexico is not authenticating the documents used to obtain the matricula against computerized data files in Mexico.

Per the center for immigartion studies website.

Since when is a passport not a government issued ID?

Not sure about Illinois, but in CA we can accept a valid passport, even a foreign passport...provided it's been stamped by immigration upon entry. The ones used now are a blue oval and have the name of Homeland Security and Immigration around the edge with the entry date in red. At least, all of the ones I've seen as of late look that way.

When I call to confirm the appointment, I also confirm that they have proper ID. I ask what form of ID they will be using, and if it is a drivers license or passport I will ask them to get it and read off the date of expiration. That way if there is a problem with it being expired or if they want us us a martricular, I know then and can head that problem off right then and there.

Like the others, I can use the passport if it is not expired, has a US stamp on it, etc.

Be very specific....

Instead of asking if the borrowers have *proper* ID, ask them specifically if they have a driver's license, state ID card or passport. *Proper* ID is subjective and left to individual interpretation, but DL, state ID card or passport are definite items.

Good gravy! No wonder we are having so much trouble with title companies issuing tons of instructions. Here we have a notary who can't even decide what ID can be accepted. Next question we will getting is "Should I take a shower before I go to a signing, or can I just put on some perfume or after shave to cover up the smell?" According to a number of my title companies, they are receiving stupid questions by the boatload and even worse work that comes back, simply because people advertise themselves as notaries and (in this case) can't even figure out that a Passport is a government document, and not issued in a Wheaties box. What's this person going to do when the property is in Trust or the person has POA for an absent mate? The signing business is turning into a nightmare for those of us who have been in the business for years, because of things like this.
