post dated checks
Just got a signing from Vital Signings for a mod wanting post dated checks made out to The Ryan Law Firm. Can't seem to get in touch with CA Dept Of RE on this one. My interpertation of the law in this reguard is that no money upfront is legal especially in CA. Any takes on this?

named Law Firm.
And I'd bet a dollar I don't have there'll be a payment issue...
Speaking of law firms, probably not a great idea to name an actual client of Vital's - what with the confidentiality issues, and all.

Thanks Susan. Didn't think about that issue. This had a smell to it after I got back to the office and pulled up the confirmation and instructions. Notaries on here are the best.

I think they made it illegal after that, though I'm not sure, as I stopped taking them before the AG made the announcement.
I agree with the sentiment "Don't pet those dogs."

Do a Google search on complaints about each of these individual firms. Also check if it is required in your State for Debt Settlement companies to be licensed. If so, check to see if they are. In MN they do need to be licensed. There are NO Federal lawyers as they like to tell their clients. I'm not an attorney, but have been doing lots of checking before I accept any assignments that even look like they are not on the up-and-up.
Also, read the document you are going to have them sign. When reading through the terms, some of these companies are charging more than the actual payments to the creditors are receiving. Many of them state right in their paperwork that the money won't be going to the creditors...the agencies monthly fees etc are paid first. If you're not 100% sure you want to get involved, don't do it. I was told by the Department of Commerce that if a customer sued one of these firms, I could also be part of the lawsuit as an accomplish for helping to facilitate the scam.
There are some valid companies out there that the states will recommend. Most at little or no charge.
