Advise
I closed a loan last Monday. Of course docs were extermley late and 11 attachements were sent...I hate that!!! Closing went great borrower's were happy. Send package out Tues have heard nothing from them since. I get a call @ 8:30 tonight saying a few docs were not in the package. I am heated because #1 I know all 11 attachements were printed and everything was signed. My question is if loan fund, because I was called to verify my address for payment early this morning and you were happy with my service, now at 8:30pm docs are missing???? Does this soundy fishy? How do I prove otherwise.

If you heard what you wrote, you also have to listen carefully for what's not said... They did NOT say YOU missed some docs; they said some docs were not in the package... I hear a ka-ching for the docs that THEY forgot to put in the package.

Thank you Lee. That is true I even said that to the attorney's office but they don't hear that. We shall see what's happen. I'm slowly calming down. Thanks for listening.

I was looking at what Lee said. It is true. Maybe they left out some docs. We are just so used to getting hit on the head so to speak. They didn't say you left them out did they? Anyhow I have gotten to the point that I save the emailed file until I know it funded. Then if there is a problem I can reprint or if they say it was there we can "discuss" it. Hope it all goes well for you.

Happened to me a couple weeks ago too. Title calls and says there was 1 doc missing. It was in the middle of the pkg, so how did my printer not print that 1 doc. I tried to argue it to no avail. Don't want to lose the client so I went back out. I combined it with another the next night so it wasn't so bad. I asked the borrowers if they remember signing it and they said yes. The doc was also in their copy pkg. I could have argued with them till the cows came home and it wouldn't have made any difference. Just get it done and be done with it.

From day 1 I have always kept the file until the loan was funded and I received my check. Only way to cover yourself.

I've had title call me back after a week because they lost part of the package. I described how I sent it, but the caller said that's not how he received it. I suggested he ask the other people who may have laid hands on it before it went to him.
Turned out three people had pulled their own portions from the package, which messed up the file. I ended up going back out for another fee to get a whole package signed again.

SS calls for a signing…notary downloads the docs prints two copies (I as many, keep a copy of the docs on my desktop) notary gets docs signed ( I don’t bother rearranging the docs in any special order I printum as I getum) takes them to courier (gets receipt) sends them to Title….a few days later gets call from SS “Title says you missed a (1-2) doc!” I say “no chance”. But no fax-backs so can’t PROVE it. Have to go get doc re-signed. This is almost never with respa docs just some ‘junk’ affidavit, usually in the middle of the package… Sounds like someone at Title when they do their clean out (pull the package apart, make certified copies, send lender docs back) is being sloppy and ‘misplacing’ the docs so they BLAME THE NOTARY!!!!! This is especially true if the docs go missing a day or so AFTER title receives them. Just part of the job, my only suggestion (and it ain’t a good one) the second time it happens with a particular title company is to bring the signed package home scan the whole damn thing in and save it. If they call about missed docs fax them the signed copy and tell them to shove it.JMO

Had one last week... They said I didn't send in the Deed Of Trust, and the Family rider... BS!... They lost um or gave them to someone to get recorded or some such thing. I laughed... 20 pages and now 10 days later you say they are missing? UMMM errr Ahhh. you had them the next day. Could be a problem but we will see. It looks like Title had too many cooks making the dinner.

I hate when they say pages are missing. You know they are not. Then they add more pages you know were not in the package. And blames it all you you.

It doesn't take them 10 days to go through the docs. So if one is missing they lost it and try to blame it on you.
I got a call once form a Ss that the D.O.T. was missing. I said that I sent it in with the package, I remember it and have it marked in my journal that it was completed. So if it's missing title lost it. If you want me to go out and execute another, I will gladly do it for an addditional fee. They acepted.
I always keep the emil in my computer until payment is recieved. That way if there are questions, I can look at the package to see if the doc was actally sent to me.
I also double check at the table and have the BO watch me seal the docs. in the package.

Another reason to keep their email
with all attachments is when they call you and tell you that you left out certain documents. When you go through their attachments .... THEY never sent you those documents.
You can then forward their original email back to them and show that they never sent those particular documents.

had that exact scenario happen....title wanted to rake me over the coals for
forgetting the last page of the 1003(loan application).
I hadn't erased the docs yet...checked them and found they hadn't sent me the last page of
the 1003.
sent them the return e-mail which contained what they sent me.
End of story.
