Closed a VA Property
I just performed a closing on a property located in VA. The SC called me and told me that I did not execute the Note correctly, that in the State of VA the Note is to be signed and notarized by the notary certifying that the Note and DOT are for the same property.
Are there any VA notaries that could lend some advice. I have also submitted the question to the NNA.
In addition, the signature line provided for the notary is right above the area for the notaries stamp, which in my perception means I would be notarizing my own signature, obvious NO NO.

Can't answer your question, but curious:
In Kansas does a notary public have the authority/power from your Secretary of State to "certify" that the Note and DOT are for the same property? Or is this Virginia notarization block on the Note cerifying this information just something you sign to "Get 'R Done" for the Virginia title insurance company.

My interpretation of the below is NO
A Kansas notary public is a person appointed by the Kansas Secretary of State to acknowledge and witness the signing of documents, administer oaths and affirmations, take verifications, and certify copies.

I have no idea if Kansas notaries can make the certification needed on a VA note. But I don't think your argument that the position of the stamp can cause you to notarize your own signature. I think it is generally understood that the stamp goes wherever it will fit. The signature and the stamp together authenticate the notarial act you have performed, and if the notarial act is authorized, all is well regardless of the relative position of the signature and the stamp. Consider a copy certification; you are the only one signing, but it is an authorized act so there is no problem.

I've refused to notarize VA notes...
because certification of anything without a signature (NOT your own!) is not a notarial act here, and in a number of states.

and to add
in Va we can certify documents except death, marriage and birth certificates. I dont know if other states can do certifications.
