Missing escrow docs

When I received docs for my 7pm signing tonight, the email said it contained attachments for the Escrow docs, HUD, POA, and Title Affidavits. There were attachments, but they were the loan docs, and payoffs. I think they must have sent them over then left for the weekend. I can't reach anyone. I have called every number and emailed all my contacts. Do I go to the signing with the just the loan docs, or cancel the signing?

If it were me, and I knew to a dead certainty that:

1. There were missing documents that required notarization, I would not go. To do so means that the hiring party has incurred an additional fee w/o necessity. Or,

2. There were no documents in any missing attachment that required notarization, then I would certainly go.

Having said that, the safest thing to do is keep the appointment. You simply can't be faulted for that choice.

I would go and use the doc I have HUD DOT POA and TITLE Aff. I would let title figure it out form there. I would send a note with the docs and let Title know what happened.

I'm sure this is after the fact now, but I ran into that

a couple of weeks ago. When I printed a file after hrs. it turned out that the title docs were for another loan. I was told to proceed & get the loan docs signed because of funding. They sent the title (escrow) docs directly to the borrowers to complete & faxback to them.
It's a tough call when you KNOW you don't have all the docs.

It is a tough choice. I know I'm missing docs. I don't want to cost title money, but at the same time, I don't feel like I have the authority to cancel a signing. I'm headed to the signing with the docs they sent. Thanks so much for your input!

Good call, Busybee!

To make a VERY generalized statement here, just about everything that could be wrong or missing in a pkg can be fixed after-the-fact, except for the Note. In other words, every problem has a solution. Other than the HUD (which is provided by Settlement/Title) and the Deed (if it's a purchase, and deeds aren't signed by the borrowers), the lender couldn't care less about the Title docs - and the TC definitely cares about keeping the lender happy.

Your choice enabled the TC to keep the lender happy (yay), and do their own docs as a follow-up.

The lender dox are frequently "date sensitive" .The title

dox are not.

I agree with the others about you making the right decision. I've been asked on a number of occasions to go do a signing without all the escrow docs (specifically no HUD, etc.) I don't like doing that, but I was fortunate that the borrowers in those cases were OK with it. At least one time I can remember, the BO was in the industry and was dealing with relatives or people he knew, and terms were such that no one was worried about it. Lucky for me...
