Copy of signed docs.
What would you do after the signing completed. Borrower said he wanted to scan the signed docs for his record. But you have another signing follow and don't have time to wait.

How fast is his scanner? Chances are in the time you take
to argue with him about it he can have it done and you're on your way.
Accommodate...as best you can. And possibly re-think your schedule so you're not booked too tightly? What if your signing with him went over? You have to schedule so you allow time for the unforeseen.

As an afterthought...I can understand him wanting a
copy of the signed docs - but they would not leave my hands - I'd scan under his supervision - would not let them out of my sight.
But that's just me.

Time is beside the point .
NEVER let signed docs out of your hands or your sight. Especially never give them to a borrower to run off with and scan/copy/whatever. Stories I could tell you when notaries have allowed this are not pretty.
Additionally, it is not your responsiblity to accommodate them in obtaining a copy of the signed docs nor it is appropriate for you to allow this. It is up to the the TC or the lender to decide if borrowers get a copy of signed docs. Borrowers need to request that service from them.

I agree with GG. Time is small fraction of the issue. As
stated, it is no your/our responsibility to accommodate the BOs with a copy or scanned versus of the executed documents. Secondly, approval should/must be obtained from the hiring party.
I experienced something similar last week. The Buyers wanted to scan documents for the lender to received the same day(it was a commerical deal). Receive approval from hiring party. Fortunately for me, I didn't have another assignment as it took the them a little over an hour to scan 122pages. This was mention to the hiring party and they compensated me for my time.

I alway tell the borrower that they need to ask the Title Company that is their job. Thats all I say and they have always said ok and then ask for the Title Companies phone number which I am happy for show them were to find it.

Lately I have borrowers asking for copies of their signed docs or official recorded copies. I always refer them to the title company and tell them to request it from them. I even send a message back to the title letting them know of the BO request.
I do not let them scan/copy anything.

I've always been told that they can request a copy of the
signed docs after the loan funds. They would contact their LO with the request, of course. No--I would not let them copy signed docs. Law requires only that they get a copy of what they signed.

The only law I am aware of regarding copies is Reg Z, with respect to copies of the TIL and any RTC (doesn't require them to be signed). RESPA would cover the HUD, again not required to be signed. Copy of appraisal is mandated - not signed.
There are certain disclosures, many of which are state-specific & I have only ever seen statutes requiring them to be provided, never any mention of "signed" copy.
As for the rest, I'd really like to know because that's not something I'm aware of?

When I was in automobile dealership management, in California, this came up.
The document originator is required to provide copies of documents an individual signs. The signor can be required to put the request in writing. The originator will need to provide the copies within 5 days and can charge a "nominal" fee.
This is for any document, not necessarily loan docs.
This was over 15 years ago but I have not seen anything revoking the requirement.

When you are done, you hand the borrower his copy, pack up and leave. This has nothing to do with what you are doing afterward, unless you are at a great restaurant, and the borrower will feed you a great lobster dinner while he scans.
Nothing good can happen by making copies after your job is done. At best you will be there for uncompensated time. Not all scanners are lightning fast, and there is always the chance that the feeder may jam or damage a page, a drink in the copy room may spill...
No notary posting on this board is being paid enough to spend unpaid time after a closing.

For heaven sakes....let them scan the documents. Cant say i blame any borrower for making such a request. Too many stories about forged signatures. My only concern as the signing agent is how fast it can be done. There is no law governing this.

Um, yeah, okay, seriously...I agree with those saying
absolutely not! It's not our call. They need to get their final executed copies from the LO or title company.
The doc's would NEVER leave my hands or presence once they are signed. In fact, as soon as I go through and re-check them, I put them into the shipping package and seal it up. I don't walk out of anyone's house with unsecured doc's ready to be dropped unless there are fax backs.

Ahhhh the operative word .. Unless.
Let's be clear...the documents are not "fully executed" until the settlement agent signs off AFTER the borrower signs. The borrowers have every right to obtain a copy of their signed documents at the time of closing if they have the equipment to do so. Simple as that. I've never had anyone ask but I wouldn't think twice about accommodating the request.

now aren't they? And they can get their FULLY EXECUTED copy from the title company "AFTER the borrower" AND settlement agent signs them.
