James B Nutter lender deals
This company requires two witnesses on the mortgage. Does the notary provide the witnesses? Does the notary charge for providing the witness??

I've done several JB Nutter and never had to get a witness. It must be state specific.

California does not require witnesses. I have done Nutter's, never had a witness and never an issue.

I was told a witness was required here in IL even though IL is not a witness state. It was an owner occupied refi on an IL property.
Boy was the borrower POed and even mention she would tell all of her friends to never use James B Nutter. She said it was the worst refi experience she has ever had!

Washington state is not a witness state but I am told that the DOT has to be witnessed by two witnesses. This is a First (only Nutter)

FL not a witness state per say, but they always want one besides yourself. 99% of the time, you witness yourself and leave it blank if you cannot find someone, and I bet title provides a 2nd one when it comes back to them. How can you bring a 2nd party as a notary to your closing when discussing personal confidential information? Only the "picky" title companies get hung up on that.

If borrowers are unable to provide a second witness
and lender insists on them, then I get permission of borrower and title to provide the second witness - I've been asked by borrowers and title if I have anyone who can do it - and yes I do but there's a fee for him. Also, he does not sit at the table while we sign the whole package as he has no need to be privvy to the borrowers' business (he knows this, understands this and I let title and borrowers know he's on board with this) - with borrowers' permission he sits in another room until we're ready for him to witness then he comes in, watches, signs and leaves.
But yes, I do ask a fee for him to attend...and get it.

Same thing I was told a month ago
Had to have two witnesses on Deed of Trust even though in MD it is not required. They told me it was a lender requirement. PS, your right, these loans are a PITA

Never had to have a witness. We're not a witness state, so you can typically leave the witnesses blank.
Yes, these files are a pain for other reasons, but witnesses shouldn't be part of that unless they've had another major change recently--I haven't seen one of these files in a while.
