Virginia Notaries - As July 1 approaches...

and notarizing by webcam looms large, do you hear from your notary public administrator's office?

This should be interesting to see how it shakes out..

that "other service" who pushed webcam notarizations within the past year is rearing its head again

FL is clear - no exception to personal appearance.

In Texas, NO Exception to Required Personal Apperance. If you are in The State of Texas needing to have a signature Notarize you MUST appear in person before a Noatry. No electronics permitted.

I've heard absolutly nothing! Probably will never hear from our beloved (?) Notary Director on any issues that affect VA Notaries. Never intend to get involved in this in any way. The former head with XYZ is the one to spear head this terrible law along with the group here in VA that he works for. Think they will probably push the sale of the equipment to lawyers and whomever else they can. One big horrible mistake passing this law but I can guarantee you it will make fraud a lot easier, We'll see what happens...........Virginia is still a "good ole boys" type of government .

I did not know that!

My guess is that the equipment will be very pricey and only large companies will have access to it. I don't see lawyers embracing this. They don't want to spend money on something that is not necessary.

Agree with what Sandra said. Here in VA we are responsible for checking the website on July 1st for an updated notary handbook or any other postings. Thing is, they don't always have it posted by July 1st. :/ I personally have no plans to become an electronic VA notary.

Having said that, I'm curious

I haven't kept up on the details of this legislation, other than what was discussed when it was first proposed. But I'm curious . . . do you anticipate any change your volume of business because you aren't jumping on the bandwagon with this?

I'm in complete agreement with you, Brenda. I've thought

all along that the electronic application will be for gov/military use primarily.
It won't affect us who do traditional notary work at all. It is a separate entity.

I wonder who is behind it.

The people who will try to use it and try to make money from it will be the ones who shoved it through the legislature. I doubt very much the feds pushed for it, but it might be a group that hope to sell something to the feds. Or maybe they hope to sell to the mortgage industry. But there is no guarantee they will succeed; electronic notarization laws that favored certain technologies passed in Utah and went nowhere.

I can see where our service will turn down any requests to do webcam remote signings in VA.

I foresee too many liabilities lurking around this type of notarization. There will likely be many lawsuits and we are not looking to be named in a lawsuit even if we did nothing wrong and our NSA did everything "by the numbers."

It would only apply to electronic notarizations (not just electronic signings) so I don't think there would be much call for it outside of some specialized in-house work. It seems that posters on this board collectively only do 100 or so esignings a year, and I have not heard of any board poster who has ever done an electronic notarization. And the chances of a notary from one state knowing how to electronically notarize a document so it can be recorded in another state are very slight.

From what I read and understood is that all electronic notarizations using the audio visual conferencing equipment MUST be recorded and your electronic journal MUST be maintained for 5 years. So Im assuming with it being recorded that would cut down on fraud. But who knows.
