another one for the Florida folks....

well, just learned my signing for this evening is on Florida property/docs. Title company has told me that 2 witnesses are required, one can be me and the buyer's are aware they have to provide another. Anything else I should know, y'all?

By Florida law, 2 witnesses are not required on the mortgage, except in a few select counties, but if it's a lender requirement then just get it done...takes more energy and more time to argue about it than it does to just comply - Smile

Florida is a homestead state - if it's their primary residence and there's a non-borrowing spouse, the nobs will have to sign certain docs.

If I were you I'd direct this question to your hiring party - let them spell it out for you...that way it can't come back to bite you - well, it can, but it's on THEM, not you or us..

And by the way - ink color doesn't matter here

I've had signings - blue ink, black ink - lender choice - as long as it's executed properly, meets recording requirements and the fees are paid it will record.

Journals aren't required in Florida..however it's

recommended we keep them - so IMO how witnesses are handled is an individual choice - I personally just record the witness's name in the journal - no identifying information or signature...not required as I'm not required to identify the witness.

There ARE instances where it's spelled out (like in instances of Signature by Mark of Signature by Designated Person, or in the case of Will signings) - in those I DO record their name, how they identified themselves, and have them sign my journal.

You'd have to refer to your TX handbook to see what is required or recommended in TX.
