Desk-clerk law and names

Forum readers who have encountered differing answers when calling the SOS, or differing interpretations of recording requirements at different county clerks in the same state, might like to read part of an article by Professor Elizabeth Emens of Columbia Law School. The part about desk-clerk law begins on page 823 (no the article isn't that long; the journal begins numbering pages at the beginning of the year).

So the next time you complain about this, you don't have to rely just on what you read on an Internet forum; you can point to a law review article.
