Why Signing Services and some Title Companies always tell you to call the borrower if you are going to be late, but they don't call you when the docs are going to be late? Double standards !

I agree…Everyone knows that the stupid people that run SS are clairvoyant! Why don’t they just tell us when the lender gives final approval…or when the loan processor at Title gets the final docs and decides (when they get around to it) to send the docs to the stupid SS. We all know that the SS’s always know when the docs will be late. Some may even not post the docs just to aggravate us notaries. Why can’t they just tell us in advance? We know that they really don't care if the signing takes place. Most are wealthy and really don't need the business. Some of us REFUSE to do a signing unless we have the final docs at least three hours prior to the signing appointment…or they the turn it back. I suggest you try this if you don’t like late docs. Oh and by the way please notify the SS if you decide to turn back the appointment and not show up.…their clairvoyance only works with the lender, and title companies…not the notary. JMO

I used to work for one of the big five lenders and believe me when I say this.....most of the time when docs were late.....it was the lender's fault. I have never seen such unorganization in my life. Too many chefs in the kitchen. Throw a motgage broker in the mix.......and you've definitely got a recipe for disaster.

However, my reference to SS and Title companies , only applied to the ones who contracted with me for my services. I am sure they will be the first to know if the docs are going to be late. Your addition of lenders and mortgage brokers will apply only if they entered into the contract with me directly.

Had one two Mondays ago at 9:30 AM for a large national TC that many of us work with daily. No docs came over the weekend as I had expected them to. I call Monday AM asking about docs and they say "Oh, the HUD has been submitted for lender approval but we haven't heard back yet. Didn't anyone call you?" No! They didn't call. No one had called the borrowers either (except me, that morning).

Alice you don't enter into a contract with a lender or mortgage broker. You are hired by a title company who the lender uses, or you are hired by a signing service that the title company uses.

Please read and see what I said. I said IF I had an agreement with lender or mortgage broker. I am not new in this indrustry and wish all the best to you all. I feel that I am talked down to here.

Peggy you seem to be one of the few here that realize that the SS never touches the docs, and rarely even looks at them. And that most times title is working just as hard as they can to get the doc’s out once they get them and final approval from the lender. It’s kind of amazing the amount of people that have supposedly been in this business for years yet don’t have a clue….JMO

If you engage in an agreement with a SS or Title you can only bill them for your service. You can't collect your fee from brokers or lenders even if they are to blame for late docs and poor communication. When your agreement is between you and the Lenders and Brokers ,then you can ONLY blame them. When you have an agreement (written confirmation) with Title and SS then they are accountable TO YOU ONLY. Who is paying you is the one you hold accountable to you.

Have you tried to collect from a Lender when a SS or Title company did not pay you?

Sorry, I do HAVE a clue and understand this industry very well. When a SS and Title company calls ....they are engaging in a legal contract with me and is responsible for all that is involved thereafter with me only. Even though ,as you explained , their connection is with others (broker and lenders )I don't have anything to do with that. My agreement is with them.

Okay Alice! You win! I suggest you tell all these “Hippocrates” that you need a three/four drop dead time to receive docs or that you are unable to accept the signing. Tell THEM not us! As far as I’m concerned your post offers nothing but whining. I do this every day, and have done so for years. When you have something constructive to offer (like how do we change this EOM rush/w late docs) I'll be listening

Les, I understand that your standards are different from mind . You call me "whining " I call it respectability and compliance in a business transaction. All I have asked in the beginning of this post, is that my contract person give me the same expectation that they require me to give the borrower.

I can’t see the double standard. If you are not going to be able to meet the people at the agreed upon time, why not call them and let them know? And try and reschedule at a different time? Most SS and title companies don’t know that the docs will be late in far in advance…so they can’t call you and tell you. Now if your appointment is in an hour or less then is should be assumed that you will not be able to make it on time….and yes I agree that someone should let you know in this circumstance. But consider… you are waiting on one set of docs for one particular time. The SS may have 20 late docs to deal with. And they just may be frantically trying to talk with the lender, the LO, title, the borrower to reschedule, and the notaries on 20 files. I would suggest that you call them (to see if you are going to get docs at all) and then go from there. Blaming the SS or even title for late docs is ridiculous. Not calling your appointment if you are running late if for any reason (except maybe a heart attack) is inconsiderate, rude, and bad business.

Even that is not true. Many times docs are sent to SS, and they say they send them but sit on them because of whatever reason: being too busy, oversight, input wrong address and I'm sure there are some reasons I have forgotten.

I sure would be interested in knowing of any SS that actually gets the docs from title (overnight?) or goes to a local title company and picks them up? Then forwards them to the notary (overnight?) or hand carries them to the notary? Or scans them in and e-mails them to the notary? I guess it could happen? Perhaps “never” was an inappropriate word? I’ll strike that and say “very very rarely”

It's not at all uncommon for a tc to email docs to the ss who then forwards them on to the notary. Some operate that way routinely. There's plenty of blame to go around when it comes to reasons for late docs, imo.

I know of no SS that routinely has the docs e-mailed to them, and then forwards the docs to the notary. Many SS have web sites where their customers (title) post the docs on a particular closing. The notary then goes to that site views the docs downloads and prints. There are cases when the Title Company hiring the notary directly will e-mail the docs to the notary. Occasionally if the notary can’t access the docs on the SS web site the SS will download the docs and forward (e-mail) the docs to the notary. The SS can read the docs, and see when they are posted, and when the notary downloads them. They still don’t ‘touch’ them, change them, or have any control over when they get them. Now I am referring to legitimate Signing Service Companies that do this as a business…Not the notary that occasionally does a ‘farm-out’ to another notary if they are busy, or can find someone to do the signing for less than they charge and try to make a few bucks on the side. Many here continually blame the SS for late docs and it’s just not true. The primary cause of late docs lie with the lender, and the way they do business today, or at times with Title when they are understaffed, and get totally jammed at EOM, but almost never with the SS. If you want to complain about late docs….go ahead, but put the blame where it is due.

Les, I think you have a valid point about the blame often being the lender, delaying final approval of the HUD, most likely. HOWEVER, I can think of at least a half dozen legitimate ss off the top of my head that routinely email documents. Of course, many others DO send docs exactly as you described - which is undoubtedly more secure.

Everyone has different clients and different experiences. I think it's probably the exception for the ss to be the problem, but I'm pretty certain - from personal experience - that once in a while, they're the culprits.
