Borrower from HELL
Contacted borrower on third attempt to confirm time and place BR: I didn’t call you back because I don’t want to pay toll charges (same area code in AZ) ME: OK, thanks. And I confirm time and place. Arrive at signing. BR: gives me original and copy of DL ME: Thanks BR: You’re going to run my driving record, aren’t you? ME: No, the copy will be sent back with the loan package. BR: NO, I know you’re going to run my driving record. ME: Would you like to call your LO to confirm what I am saying? BR: NO, I don’t need to. Start with HUD BR: There aren’t supposed to be any costs to this loan ME: Correct, on the HUD here is the loan that’s being paid off and here is your new loan. Here are the settlement charges and here is a lender credit for the settlement charges. BR: But there aren’t supposed to be any costs. ME: There are no costs. The settlement costs and the lender credit net to zero as I pointed them out on the HUD. BR: I don’t like the format of the HUD document so I won’t sign it. ME: Are you refusing to sign? BR: No, but you will have to take me through all the numbers in that (points to loan package) before I will sign anything. That’s your job!!!! ME: Perhaps you should call your loan officer for some clarification on the numbers and my roll here. BR: NO, it’s your job and I’ve been lied to before and that’s exactly what you are doing. ME: This signing is aborted due to your refusal to sign. As I am leaving she is screaming at me all the way to my car that I am “Crazy”.
I reported this to the Title Company and received a print and trip fee. In over three years this is a first and hopefully a last.

WOW, and you kept your cool through the whole ordeal.
Good call to leave since safety is always no. 1, and that was questionable in this situation. I know it's a skill requirement in this biz or any other in knowing how to handle difficult situations & people. I think you handled this very well. :-)

Definitely crazy...but, I have never shied away from going down the column of numbers on a settlement statement. But, if you had, it would have just been something else...better to cut your losses and move on!

I interpreted what the OP was saying to be that the borrower would not sign <anything> until every single document in the packet had been explained, and the numbers verified.

Since, I interpreted it a little differently than you 2 did, I am going to -take it personally -be indignant -hit the Report button -write Harry, Tracy, and Griff -fax them until they call me -hang up on them and then slam my cell phone down and probably break it -post disconnected angry references about this on Facebook ["OMG OMG OMG" "OH, H3LL TO THE NO." "Aw, h3ll no they didn't just say that" and tell anyone who asks what's wrong, "some things are just too private to talk about" -cannon ball a glass of wine (no, seriously, I am)

You are right and that's when things started going sour. I reviewed page 1 & 2 of the HUD in detail with the BR. She then wanted to know what the monthly payment was so I showed it to her on page 3. She then compared the monthly payment to the lender credit and demanded to know why the difference. This was going nowhere very quickly and she was not interested in any answers.

As I understand it, in CA that is considered giving legal advise and not allowed by notaries? My understanding is if the signer does not understand a document, he or she needs to talk to the loan officer for clarification. Am I misunderstanding CA law?

Every once and awhile we all have one. I had one so bad last month that I was only a 1/2 a mile away when I realized I had left my jacket. I decided he could keep it- I wanted out of there and did not want to see his smiling face again! Guy was not even polite enough to call me and tell me it was there. But I knew - and decided I would rather buy a new one!
