Believe it or not…

The CA SOS issued new guidelines this past Friday for disciplinary actions against notaries in CA for various offenses.

On the list is spousal abuse. Let us not forget the Sheriff in San Francisco grabbed his wife’s arm with one hand during an argument and left her with a small bruise. He may lose his job over this.

According to the new guidelines issued Friday this offense could cost a notary their commission. I kid you not. You can find it on page 12 of the new guidelines.

Be careful out there.

LTK, not a single word of what I mentioned in my post was even remotely discussed in the message number you suggested discussed this issue. Go back and read it again for yourself if you do not believe me.

I will rephrase my post title: Disciplinary guidelines

recently MENTIONED in msg. #443688....'cuz you specified an offense from the guidelines changes not the point of my post. Is that clear now, Mobile Pro Notary?

What do you do when the borrowers almost come to blows? I had this situation tonite - first time ever. She wanted to stay with current lender, he arranged this loan thru another lender. All over a difference of $110. Most embarrassed over the whole situation. Finally settled down and signed but don't think it's over. Glad to get out of there safely

Thanks Linda, me too.. Got a snarky PM from his Majesty Pro Mobile wanting to know what that had to do with his post. Just pointing out our conduct must be above reproach but borrowers can do as they wish........we're held to a much higher standard of conduct than the average person.

I am certain the His Majesty is a good business man...he has a fine track record on SC...but, he is not a good customer/vendor relations guy when he is not on this board irritating his vendors. He could learn a lot about how to endear his contractors and hiring entities just by reading -- and, not sending pms or opining that EOs are lazy when they do a perfectly common thing like sending out a "mail away" loan package.

So, let me see: Someone does you the courtesy of sending you a <private> message about your post, and your response to that is to publicly call him a name and take him publicly to task for keeping any less-that-laudatory remarks private?

If you suspect coercison.. you leave. ASAP.

I've had this happen before... and there were guns laying around all over the house too... I'm good with guns, but guns plus spousal hostility = NOT COOL.

I left saying I needed to review some items with the lender.

(Item in question was that the wife was clearly being badgered into signing something she didn't want to sign).

To be fair, violence was never threatened but to me it was clear that it was implied (not necessarily with guns--I think they just happened to like guns). I'm from a family of gunnuts but common courtesy and good sense indicates that you put those the heck away when you're expecting company...

There was a severe shortage of courtesy and sense in that household.

I'm perplexed by the tone of your post, that you cannot believe a notary could lose their commisison over something like spousal abuse. Your phrase: "I kid you not," points to your incredulity that spousal abuse could actually lead to revocation of a commission. Are you befuddled, shocked, amazed that the SOS would include spousal abuse on its list of no-nos?

Even more perplexing is that of all the dozens and dozens of forbidden items you could have picked from the 51 page disciplinary list (child pornography, carrying a concealed weapon, fraud, etc.) why of all things did you focus solely on spousal abuse? You then chose your words carefully to describe the incident involving the sheriff where he left a "small bruise" on his wife's arm inflicted with "one hand," implying this was a minor happening blown way out of proportion. but that it could happen to anybody.

"Be careful out there" are your parting words of wisdom? Meaning: Stop beating your spouse if you're a notary? If the SOS can revoke a commission over spousal abuse, then what's next?
I know, it's a world gone nuts. I kid you not.

BTW the sheriff of San Francisco was charged with domestic violence battery, child endangerment and dissuading a witness. He pleaded guilty to one charge, spent a day in jail and has been reinstated to his post by the Board of Supervisors after his suspension by the mayor. Sounds like got a better deal than the SOS plans for notaries.

I'm not baffled at all.

No wife ever killed her husband, nor woman ever killed her lover, who did not cry spousal abuse. It doesn't matter what the circumstances of the crime are, and how unlikely that such abuse was as the motivating factor, spousal abuse will be pleaded. No woman ever went into a hotly contested divorce without raising the specter of spousal abuse. It is the most used, and most misused, defense by women who seek public or judicial sympathy; that's so because it works. One of the reasons it works, of course, is that by the nature of the relationship actual spousal abuse will most often be hidden from the view of others, so it can be alleged, falsely, with impunity.

I gathered that what the poster was saying was that an allegation of spousal abuse is an awfully weak excuse for destroying a person's means of earning a living, especially since, even if true, it would have zero relevance to the duties of a notary public.

Baffled? You are grossly distorting what I believe to be the intent of the original post.

After seeing a number of your posts I think you just like to jump all over PMN at every opportunity and unjustly I might ad. You are out of your bleeping mind for your over-the-top response to the post.

Stop over reading into the post and lighten up. Nowhere in the post does it come close to diminishing the act of spousal abuse, but you certainly are engaging in PMN abuse with your inappropriate post GOLDENGIRL/CA..

Hmmmm, now I'm even more baffled. You're taking this awfully personally. Are you by any chance PMN under a new alias? There is no history of "FormerEO" until this very post, as far as I can see.

Also, I don't recall ever having responded to one of your - excuse me, one of PMN's posts before. Hardly jumping all over PMN "at every opportunity." Unjustly or otherwise.

Actually, I just did a search and found I did respond to one of your (PMN's) posts (started by another notary) about RTCs and my response was "Excellent Point, PMN." I know PMN and I agreed on another point but disagreed on somebody else's post about desperate notaries, but then everbody seemed to have their own point of view on that one.

Just sayin .....
