I was asked by another notary this intriqueing question. Can a claim be filed and processed to you E & O without you (the insured) not being notified of such claim?
My answer is pending but it would be amazing if a false claim slipped through.

Guess I better read the fine print on my E&O policy with Merchants. That would be terrible, however, I'm sure that if there were a claim, Merchants would definitely tell me about it.

In a word...yes

Usually you will be notified, however, if it's a really small claim, they could (not saying will or would...just 'could') just pay it to make it go away. In general, if you read the small print, the decision to pay or fight it is theirs; not yours. That sorta explains why everyone and their dog gets named...they hope everyone & their dog's E&O pays rather than fight and consider that a win/win.

This is personal experience...granted, not in the NSA field, but I'm guessing it applies to all E&O everywhere.
