So I had a refi with First American Title (FASS) who used to be one of my best clients. But let me say they are going down hill and there quality control- exception dept do not know what they are doing. I had a Bank of America closing last Saturday and the RTC dates were wrong they said like the 17th not the 20th. They were changed to the correct date and initialed by the borrow all correct like anyother time the rtc dates were wrong. Well I got an exception from them saying that the instructions said that the rtc dates could not be changed. Has anyone ever heard of this? I have always been instructed to fix the rtc dates if wrong. I think BofA and Fass are both losing it. any input on this email me at [e-mail address]

That is a standard instruction for BofA RTC. I usually give the signer their copy with the correct dates in case there is a dispute with BofA over the right to cancel. I also have the signers sign and date their copy under these conditions. At least the signers have some proof of the actual date the RTC was signed. As Judge Judy says "do you have any proof you signed anything on this date?"

On BOA loans you don't change the dates on the NRTC copies going back to escrow. I only change the dates on the borrowers copies with the correct dates if they are wrong.

BofA rules, if you read the wording on the RTC the cancel date changes to 3 days from the signature date.
This is true on most of the RTC forms I have seen, but they have us change them anyway so as not to confuse the borrower. But, yes, Fass is, well, a pain in the Fass!

Re: First AMerican Title-BofA Rules, do not change NRTC!

This changed a while back. If you read the instructions, it specifically states not to change the NRTC dates.
