Here's another moral question to ponder...

I call to confirm appointment with borrower, who says the day (Saturday) and time is not acceptable. His L/O has given him permission to take his overnighted docs to another notary and location on Sunday. My phone calls and emails to title go unanswered and leave me with no clear direction or their position on the situation. Since the borrower has refused to meet with me and he would not be home at the scheduled time/place anyway, I considered the assignment canceled. Two weeks later I receive a check for the agreed fee. Mind you, a considerable amount of time was taken in my attempt to unravel the confusion between parties and still not get a straight answer back from the title company. I was tempted to cash it in for all my trouble, but after all, I did not travel to the borrower or provide him with notary services.

I again emailed title about the entire situation and asked if they want me to return or destroy the check. To this day I have not heard back from them. It is obvious no one wants to take responsibility for the errant check. Here's my question: If the borrower has paid for his notary services out of pocket, then shouldn't he be refunded the amount that was sent to me? What's your take?

You don't know what the borrower paid or didn't pay. Don't drag him into the middle of this. Just cash or don't cash the check depending on your understanding of what they may or may not be paying you for. It's unlikely they would pay you full fee for doing "nothing," except spending an inordinate amount of time on the phone trying to figure this whole thing out; then again, it's not unheard of that this is payment for all your time and trouble.
Sounds more like a disbursement error, but ya never know! Since they refuse to respond, guess you will never know. I just had a TC pay me full fee for just printing... I was on my way to the signing, but borrower canceled appt. shortly before I got there. I told title I'd be happy with the print fee, but they insisted on paying full fee, saying it wasn't fair to me that the borrower pulled the rug out. OK with me!
