Instructions new to me

I copied and pasted from the three pages of instructions, this is from a lender I've heard of but never had one of their packages. They also include a list similar to the new Chase list of docs to be notarized.


IN CASE OF PROBLEMS WITH THE RATE, FEE, OR TERMS OF THE LOAN: HAVE BORROWERS SIGN
DOCUMENTS, NOTARIZE THEM AND LEAVE EVERYTHING WITH THE BORROWERS, INSTRUCTING
THEM TO CALL THE AGENT/PROCESSOR FOR RESOLUTION.

The acknowledgment included in this package is optional. We strongly encourage you to sign and stamp it just
in case you forget to sign or stamp or make a mistake on one of the loan documents. This acknowledgment
can only be used for the documents in this specific loan package.

yeah, its nothing really...good to have just in case though.

I'm talking about the extra ack...with regard to the bolded part of your post...

hasn't happened to me, but whatever, I'll do what they say...they're paying me so...

In my part of the notary world you can't give an acknowledgement without having it attached to a certain document. How do you know that someone isn't going to forge a document with the borrowers name and attach it to that document? No way on earth will I sign a blank. Also, when I see them, I just cross out and initial and leave it in the doc package. Never any issues. If they have a problem with it, I will have them talk to my Secretary of State. JMHO

I hope you're just being facetious... There's no way I would fill out an extra ack for them to add to just any doc in case they need it, whether or not the borrower(s) know about it or agree, and whether or not it every gets entered into the notary's journal! That's wrong on so many levels!

When I see those, I either toss it out or just leave it blank. An unattached but completed acknowledgment is an invitation to fraud.

I do not complete them! I once questioned the sender of the docs about the reason for the extra ACK and was told, "Oh, it's just in case we need it for anything!" Duh.............

I've seen them slipped in packages but never has a lender actually admitted it and typed it out in their instructions. Leaving docs with borrowers? Really strange, not even a mention of calling from the table.

I did one signing where they ask for an extra ack just in case they needed it. I wrote back and told them they wern't going to get it because it was against the law. In California loose acks and jurats are not allowed, they have to be stapled to the document they are for.

Yeah right, borrowers are just going to agree to sign something that they don't agree with. Wait, I have a great idea! How about the rate, fees, and terms be exactly what was disclosed to the borrowers and how about the loan office go over the HUD with them prior to closing?

Exactly! These kind of instructions ask us to do something

that is illegal so they can cover their butts. I don't think so.
