In a license state we are not "Signing Agents" nor are we " Closing Agents" We are "Settlement Officers/Agents". We can hope the title company using us in this state knows the laws and documents necessary to record a Deed of Trust? Most do everyone once in a while the Maryland Refinance Affidavit is omitted from the loan package. So carrying an affidavit (General Affidavit or if the county has posted one on the internet such as Prince George or Howard Counties) It is just as much our responsibilty to see to it the affidavit is signed by the borrowers on title. If it's not signed the deed of trust cannot be recorded i.e. the homeowner goes to refinance again or wants to sell their property and guess what?? They can't sell the property nor refinance. Who do you think they will come to YOU first!!! This week I'm fixing 14 refinance loans for just "ONE" title company where the Maryland Refinance Affidavit was omitted. I have one title company that states in their documents if it is left out my fee would be reduced by $25.00. Please take the responsibility to keep them in your briefcase and/or just throw one in every loan package just for the heck of it. Believe it or not the title company will praise you for due diligence.
