A new twist for me
I did a refi signing tonight. In the package was a grant deed, they were adding the wifes middle initial. They both signed, so far so good. As I started to fill out the ack attached I always read them because the wording for California has to be exact.
It read:
Who proved to me on the basis of satisfactory evidence to be the person(s) whose name(s) is subscribed to within the instrument and acknowledged to me that she executed the same in her authorized Capacity(ies) and that by her signature(s) on the instrument the person(s) or the entity upon behalf of which the person(s) acted, executed the instrument.
I certify under PENALTY OF PERJURY

OOOOPS I must have hit the wrong button before I finished.
I just added her on the ack, then after thinking about it, ( they both signed) I decided that the ack needed to include both of them so I attached a loose leaf cert.
OK Marian, comment please or anyone elce.

Good for you on the loose leaf, isn't is amazing that our instinct (when we actually follow it) leads us, most often, in the correct direction. Actually, if it had been only her, the Ack language is slightly off. I formatted individual and/or separate acks for he... she... they a long time ago. Our SOS leaves that part up to the individual recorders office, I have Never had a problem, regardless of the county or a state other than CA.

Hehe.....
I think it was a good catch, if I'm reading this right. At first it just had her, so the pronouns just referred to her/she, right? If it were too difficult or messy to correct then yeah.... attach a new one and be done with it. I probably would have.
