She vehemently denied that the docs are password protected. Then she said that my husband has to request them because I am not on the loan. She is coming back this afternoon with the docs and asking my husband to sign for them.

You probably know that when docs are password protected they are that way if you email them to someone or put them on the disk. That's the purpose of password protection.

A trip she could have avoided if she just did the job the right way to begin with. And you can give her back the CD with the password protected file, because it's basically nothing more than a coaster for you...
With an attitude like that, she won't last long in this business.

She probably didn't realize that once a file is password protected by title, it's always password protected. It doesn't matter if you copy it or email it to someone. so, she came back . We got the docs and we gave her back the disc. My LO was upset about this from the getgo because he likes to present the docs. she took charge of the whole show. When I have an LO present, I always let them take charge. They like it that way. Everything from the missing borrowers copy to the taking pictures of our ID without asking, to her insisting that we should have our money wired, and last but not least that she never ID'd my husband just left a bad taste in our mouth. Too bad I didn't have it on camera. It would have been a good youtube notary training video!

Curious--since you're in the biz, why didn't you request a
notary you knew? This sounds like it was a very awkward situation, since you weren't on the loan but involved yourself in the process. Not defending that notary, but I do see instructions all the time about taking a copy of the ID with a camera or cell phone. It's sounds like it was a loaded situation, and I wouldn't have wanted to be that notary. ;-)

I've requested a particular notary or tc, and that's been
honored without any problem. I'm sure you've seen the form in the pkgs.--we have a legal right to choose.

I have closed loans before with notaries and have
never had a problem. Why should it be awkward? Even the LO was PO'd. When he closes a loan he wants the borrowers copy so he can go over it with the borrower. You can bet that after 39 years of marriage, I will be involved in the process. I always ask the borrower when I confirm the appointment if they can get a copy of their ID. When I get to the table, if they don't have a copy, I will ask then and there if they can make one. If they can't make one, I will ask them if it's ok if I take a pciture of the ID. I would not just automatically grab the IDs and take a picture. I feel that I need to be respectful of the borrower.

The above statement contradicts. You are saying she took pictures of "our" ID without asking then you say last but not least she never ID'd my husband. So she only took your ID, not his??
I too always tell them in the initial confirming call to have copies made, but sometimes they don't. If they don't, I ask them if they have a copier, if not I take pics on my phone. If for some reason they do not sign (rare), I delete the pic off my phone in front of them. Makes them feel better.

I will correct that statement. She started to take a picture of my husband's ID without asking. When I say she didn't ID my husband, I meant that she did not put his info in her journal, nor did she ask him to sign. Isn't that the first thing you do? If the ID isn't right, you can't proceed with the signing.

Gotcha. Makes sense now. Yes, that's the very 1st thing
to do is ID. She sounds like a real winner and I bet she makes a lot of mistakes. Too bad she is giving this profession a bad name. Wonder who trained her??

Hi, Shoshana. I know you're irate about how this signing went. All I was trying to say, hearing it from an outside perspective, is that it isn't necessarily good form to bash a notary on a public forum that is about professional notaries. I completely understand your involvement in the situation. We don't know what the notaries instructions were. Frankly, if it had been me, I would have been uneasy taking directions from a person not on the loan. You know all the stuff about privacy, etc. She screwed up and I get that. The last couple of loans I've done I either requested a certain notary (& got that person) or this last time closed at the tc's office, because I specifically didn't want another notary (competitor) knowing my business. IMO RM's are particularly sensitive transactions, and I've done a lot of them. On the flip side, I have one local LO that insists on trying to control the signing. She is disruptive, and is constantly talking through the signing process. I was told a long time ago that we control the signing, and anyone, including the LO should not be interfering. With RM's, I'm glad when the LO is there to answer any questions. Most of them know not to interfere with me doing my job. They've done theirs, then let me do mine. They can go over any other details when I'm finished. At least that's been my experience. I hope the outcome of the RM serves you & yours husband well, and that the signing experience doesn't mar your overall experience. Regards, Marilynn

Marilynn, I hear what you are saying. I did not mention the TC, Lender or Notary's name. I never would do that. I don't believe that any TC would tell a notary to not have the borrower sign a journal or that they could only deliver a CD of the docs and not a hard copy. She never let the LO do his job. She took control of the entire signing. This is a RM - something we had never done before and wanted to hear what the LO had to say. The LO particularly in a RM situation should be explaining the docs. All the RM LOs I have worked with both here and in CA have done it that way. I would be interested in knowing who taught you that.
By the way, when you are happily married for 39 years and know each other for a total of 43 years, there is no privacy between two people in a healthy relationship.
I am glad to hear your perspective. I respectfully disagree with you.

Because as Michael said above, it usually doesn't work that way. TC generally wants its own notaries who are already contracted with them.

Because it's the principle. She needs to learn how to do things correctly. Secondly, I am paying her fee. Why should I pay additional money to print out my own docs?
