Stepping into the hornet's nest...

Had a closing tonight, thought it would be simple and straightfoward, was I wrong.
Called borrower to confirm the other day and she asked me about the QuitClaim Deed. Told her I would bring what ever docs were sent to me. Was looking at the docs and wondered why there were not NBS docs for the husband. Well, found that out when I got there: wife not home yet, husband starts bad mouthing her and then tells me he is not signing the QC Deed until "the Papers" are filed at the courthouse. Loan can't go if he does not sign. Wife comes home and they start arguing. Turns out, they are about to get a divorce! This quickly starts getting ugly, making me uncomfortable. Call title for advice, title talks to couple, they start to sort out. Wife asks me if I can come back in an hour, fortunatly this was my last for the day, so I said that I could. Leave house, call title again, they make a note to pay me extra if I go back. I went back and we did a quick sign. Docs to go out tomorrow. Big thank you to the title company for having my back and helping out. Was one time I was glad that title is in CA and was still there.

This is exactly the reason good notaries like you should not cave to lowball companies. A lowball notary would have not known how to handle the situation and it would have ended in a no-sign! The divorces are always the most difficult to deal with. I don't mind screaming kids or crazy dogs, especially when I think "at least its not a divorce!"

I also appreciate this post. It bespeaks the experience that exists among many of you professionals.

I just recently learned more about NBS and his/her role - particularly when signer/borrower owned property PRIOR to marriage. My "untrained" NSA "eye" only saw that Title did not include spouse's name on any of the docs, including the DOT. But I still questioned in my mind: Even though not vested on Title, doesn't she still need to sign? Of course, I didn't question aloud; and got an email today from SC asking me to do a resign.

In reading the accompanying title emails, they acknowledged not including wife's name. But SC just sent me an email saying "to disregard" request for resign.

Wonder if NSAs have to take all the blame for errors and/or not be expected to get paid to go back when not at fault - at least not entirely (here, at least is where I agree that more Experience would be beneficial).

Good job, ajd AND to Title for giving "credit" $$$ where credit was due!!

Thanks everyone. that was one closing where I was glad it was close to my home (about 15 minutes away) and I was able to run an errand while waiting to hear from the Mrs. I can handle the dogs checking me out (I also work in a veterinary office) and the kids (except for the one mom who insisted on feeding the almost toddler during the signing), it is the arguments between the couple that start to make me nervous.
Thank you to everyone on NR who post and provide the rest of us with advice, tips, and support to make us all better notaries. It is from reading this forum for all these years that I have gotten the courage to stick to my guns and fees.
