An actual phone call today

Me: Hello I'm calling to verify an appointment for tomorrow for you to sign an Affidavit of Death

Borrower: Oh, I really don't want to sign that.

Me: Why?

Borrower: Because the State of California will come after me.
Me: Why?

Borrower: Because we have been making house payments with my mother's social security checks.

Me: Well, how long ago did she die?

Borrower: 6 years ago

Me: my jaw drops to the floor. Grandma's been dead for 6 years and you still have been cashing her checks?

So what happened when the other shoe dropped? Did you contact your hiring party to let them know you couldn't get the affidavit signed?

And I don't think their worries are with the State of California. Social Security is Federal, and we all know how the Feds hate fraud.

Not necessarily, but there is indeed a high probability. Fraud is fraud regardless of the fashion. It especially does not sit well for her circumstances that she has shown cognizance and contemplation of the fact and continued anyway. In the words of Bob Dylan:

"Walk away, oh
Save yourself from the heartache, oh
Go now before it's too late
So walk away"*

*caveat - There is rumor that Dylan himself plagiarized these words. I was neither present nor born and cannot attest to any such fact.

My mother passed away on the 3rd of the month. Within days I recieved a letter from social security demanding the return of her social security payment for that entire month.
Yes they are NOT very understanding when it comes to "their" money.
Now for you as a Notary, do you understand the positions you are NOW in.
Losing my Notary commission would be the least of my worries.
Having my name associated with this Federal fraud would give me great worries.
Even, if, you do NOT do this, knowing what they have told you, I would be worried, when it becomes known to the social security and they find out I knew about it, the federal prision time would send me to the nearest social security fraud investigator with my story.
I personally would not last long in federal prison.

I have asked the moderator to delete this thread. The problem has been resolved. No federal or state money has been dispensed unlawfully. End of story.
