50 complaints against notaries a month in Fla? That seems so high, I wonder what it is in other states.

I always like to read the comments from the public that are associated with articles from media. In this case, the comment has me worried: "You need to sue the notary. They are responsible for everything they notarize."

I would also like to hear the notary's side of the story. It was stated, " She is apparently notarizing stuff without even looking at it," Baptiste said. What is she saying? That the notary wasn't in the presence of the signer at the time the notarization took place or that the notary did not read the document itself before placing her signature and seal on the document.
We are there to ID the signer, make sure the document is complete and to notarize, not analyze.
And did the notary suspect any foul play at the time, or is this a very innocuous act on the part of the notary who is again being blamed????

Of course they should sue the notary since she apparently notarized a signature of a person who wasn't in front of her, she facilitated the fraud by not properly identifying the person signing the document. She could be held responsible by the court for any costs and damages to the heirs for her participation. And since Florida suspended her, I believe the State validated the heirs claim.
I've had several try to get me to notarize things without the signer being present and they get furious with me for refusing and start threatening me with getting my commission pulled for not notarizing their documents. The best one was when a guy was signing mortgage docs with a POA from his parents, they were out of the country. He mistakenly gave me a copy of his mother & father's driver's licenses, then gave me the POA for the property, the signatures of the parent's didn't match the signatures on the POA. It turned out that a notary let them sign a POA for mortgaging the property, using a general POA that the parents had signed for taking care of the property while they were in South America. In addition, the notary let the son and his wife be their own witnesses to the signatures. Needless to say this loan didn't go through, I contacted the lender, TC, and parents, the son would have walked away with $200,000.00 cash out on his parents property if he had succeeded with this fraudulent transaction. The lender and son were furious with me for not continuing with the loan signing, the parent's and TC were very glad that I stopped the signing.
When I left I contacted the SOS concerning the notary that had notarized the POA using a POA. I forwarded the copy of the POA's to the SOS, I don't know what the SOS did, but within 6 months she was no longer listed as a notary for the State. I didn't need to know this notary's side of the story either. That notarization on the POA was all the proof I needed to know that she was completely incompetent or helping to facilitate a fraud. Either way, she needed to lose her commission.

I believe there is much assumption here, and it is difficult to garner the actual facts, as the article really does not delve too deeply into what the notary did, or did not do.
