Power of Attorney

I was asked to do a power of attorney signing today on a piece of real estate. The principle agent is not to be present. Have any of you had a singing like this? The mother who owns real estate in another state is giving power of attorney to the daughter who does live in this state.

I have done these, most often for VA loans where the vet is out of the country. They work the same as any other signing, except you need to be aware of the following:

1) Find out how they should sign on behalf of the person who is not present. Sometimes the wording showing below the signature line is correct, and sometimes the company wants wording not showing on the doc, so it is always best to ask. It most likely will be signed something along the lines of "James D. Doe by Jane M. Doe, as attorney-in-fact"

2) Find out if you need to obtain the original of the POA so that it can be recorded along with the mortgage/Deed of Trust. Sometimes the company will already have the original and sometimes they expect you to get it and send it back with the docs. Either way the borrower will get it back within a few weeks, once it gets recorded.

When you verify specifically how they want the

signature line to be signed, also find out how they want the docs initialed. This can vary and you want it done right.
