Bank of America loan modification
I did a loan modification for Bank of America last week. There were three loan modification agreements, the deed of trust, the note, and all need the signatures notarized. The deed of trust had 8 pages, page #7 had a signature line and Ca. ack, page #8 is another Ca. ack. Bank of America wanted both notarized. I notarized only the first page and cross out and initial the second page, but they are saying that I needed to notarize both ack. Are any of you providing two ack’s for only one notarized signature?

No, thank goodness. However; most of us know full well the pressure your hiring party is no doubt putting on you to perform on B/As demand (notice I didn't state "request"). You completed this notarial act correctly. We simply cannot include an additional ack without added documentation. While a few Lenders are now including two DOTs, etc., in their packages, as you posted, this was not the case.
It seems to me they are looking for a "spare." I can only hope that B/A hasn't decided to put a spin on their Robo Signing days and incorporating us .

Some companies want each signer to be acknowledged separately. They don't want Don Jones and Jane Jones on the same certificate. If you only have one signer, only one ACK; two signers, use both certs.

I did one of these for a direct client. It was about 12 notarizations for one loan modification package, including duplicate originals. They sent a "new" exact duplicate package back to my client and said the acknowledgements were wrong. Fortunately, my client kept a copy of everything she sent them. I went back and checked all my forms, nothing wrong, and as you mentioned, we used "their" California acknowledgement forms that came with the package. She got a bank representative from California on the phone while I was there. He said the acknowledgements looked fine and didn't know why corporate wanted them re-done! I advised her to follow up with an email detailing the conversation and to let me know if she had any other problems. I haven't heard back, so assuming they accepted them as is. Since she was a referral from another existing client, I did not charge for this "extra" trip and my client emailed me a nice thank you.
