I am so annoyed
with myself. Just got my new commission and two new stamps through NR. Thank God I got two stamps. Anyway, 4 days into my new commission and I take my Stingray stamp out of my bag only to realize that the cover has fallen off of it. It's rattled around in the bottom of my bag and gotten scratched. So, now when I stamp, I get a scratch mark/line in the middle of my stamp. Lesson learned...a) make sure the cover is on tight b) put stamp in plastic baggie c) clean the crap out of my notary bag.......thanks for listening.....

Is there a law in CA that your stamp cannot be scratched? Many times, my stamp cover has fallen off in the last 11 years and the stamp has never gotten scratched.

What a weird question!!!!! There probably is not a law but common sense is telling me that maybe, just maybe, the OP is having issues with the scratches because they are affecting the quality of the actual stamp on paper. Maybe, just maybe, that might be a problem when there is a deed being recorded, right? Like if the scratch happens to be across the notary name and is not legible???
Just a thought.

Well, she said it was in the middle of her stamp, but didn't say that it obscured anything. Just a thought.

It says that the impression needs to be legible and able to be legibly photocopied. So, if any damage to the seal makes it so that's not possible, then yeah... it can't be used.

Shoshana, in our handbook it states in part, "Notaries public are cautioned to make sure that the notary public stamp leaves a clear impression. All the elements must be discernible. [ ] An illegible or improperly placed seal may result in rejection of the document for recordation [ ]". This can be found on page 7 of the 2013 Handbook.
So, depending on the severity of the scratch, it may render the stamp unclear. It is better to be safe than sorry.
Notarydi/CA it's great that you had a spare with you. We all should as one never knows what can happen.

Here in AZ we can legally only have one stamp at a time! However, one can go to a local store and have one made up in just a few minutes if need be. All you need is your commission.

day. I was notarizing docs and my stamp broke. The borrower was nice enough to give me some nail glue and it temporarily fixed it enough to get through the signing. The next morning I called Office Max and got a new stamp with the proof of commissin and my DL in about 20 minutes.
