While experienced NSAs should know the difference, the following training from Mortgage Connect might be helpful to some people reading this forum:

ACKNOWLEDGEMENTS AND JURATS

An acknowledgment ensures that the signature on the document can be trusted by the receiving agency. Many important documents, such as recordable documents, loan agreements, and powers of attorney require acknowledgments.

A jurat (verification upon oath) requires the signer to be compelled to truthfulness regarding the content of the document. The signer is required to take an oath/affirmation before the notary in order for the receiving agency to trust the signerˇ¦s statements within the document. Jurats are often performed on affidavits and depositions.

For both acknowledgements and jurats, the following must be true:
„Ď Signer personally appears
„Ď Signer is positively identified

For a jurat, the signer must swear to the content of the document.

Acknowledgements are more widely used, particularly within the context of a loan signing. Its main purpose is to positively identify the signer and verify that the signer signed freely.

Jurats must be signed in conjunction with an oath or affirmation being administered.

I think the writer of the educational information needs to learn when to use the word "must." There is always an exception to every rule.

I'm not exactly sure why MC and other companies are putting out this information. They wouldn't know a preamble, appearance clause, or conclusion if they hit the company in the mouth.
