Venting - Title Source Defect Report

I had a closing last night on a JP Morgan/Chase loan (rental property in NC - borrower in CA) and did faxbacks as required. Received a defect notice that the 1003 was not received nor was a letter of explanation received. I knew that I faxed back the 1003 and challenged the issue and reported back that I had no knowledge of a LOX being required. I hadn't dropped the package yet so I refaxed the 1003 and told them if need be (as support of my challenge) I could fax the confirmation my fax machine provides which would show the number of pages faxed. I also highlighted two mistakes made by the lender in the closing package which were taken care of at the time of signing. (I know highlighting the lender's mistakes was childish of me.)

I received a reply that they did receive the 1003, but I needed to fax the LOX and that it was clearly listed on their faxback instruction sheet. Well dang it if they weren't right about that (slap me in the forehead)! Of course, after the words Letter of Explanation the words "if applicable" appeared. No where in the package was there any details about a letter of explanation. The form instruction letter was for TX property and had listed several forms required to go back "if applicable."

I feel like someone dropped the ball on this and it's "Let's blame the notary!" I've been working with Title Source for probably 3 years now and love their Quicken Loan packages. Fees are on the low side, but they are quick easy packages and borrowers are well informed. I've never had a borrower complain about them.

Feel your pain.. Big Time..

App has not gone off for a week, and we getting no where quick with VM..

I totally understand...

Isn't is amazing how little we are worth when someone else sets the value for what they "think" it is that we do. Yet, how very valuable we are when they are at fault, all they have to do is open the door and let the "crap" roll down hill away from them as if that covers the fact that THEY sent you an incomplete package. They think we are idiots.

They send over mile long instructions that contradict what it is they actually want you to do. They want a witness closer. A witness closer is only there to do one thing which is witness signatures. If they wanted someone to actually scrutinize their package, go over the faxback list and actually match up the documents included in the package that are on the faxback list and call them on the "IF APPLICABLE" docs just to make sure they did not mean to put them in there (you know, tap into our mind reading skills).....well, then maybe they should have included those very words in their instructions. Maybe they should remove "if applicable" and clearly state if anything is missing on this list please call us now! Wow, clear, concise communication...what a novel idea.

You are not responsible for the preparation of the package. If something is missing, it is on them...period. Don't take it personal. The person at fault is the one who prepared the file and should be the one who has to rectify the missing LOX at their expense...not yours.

absolutely, if LOX in pkg then yes it should have been faxed

if wasn't included, not your problem.

about that missing 1003. I had defect problem. TSI adobe

reader turned out to be the real problem! Do you send as pdf? If so, may be their adobe. they said I was missing pg 4 of the HUD and pg 3 of the DOT. since I review my scans before sending, I knew it was there and after several back and forth emails they finally discovered and acknowledged they were having problems with adobe. fortunately, I scan and email or fax so I have a copy of what I send and I resent just those two pages.

I have found them to be reasonable in removing defects via challenges.
