What Notaries/Loan Signing Agents Need is Legislation

Advocacy....getting paid fairly and timely by all signing services.

Any ideas.

Independent Contractors don't get legislation.

My view is that while legislators are tightening-up re the privacy & internet fraud (not getting paid) issues for the consumer re the loan process--something will eventually trickle down to us acting in our Signing Agent capacity. I truly believe the SS are going to come under some harsh scrutiny b'cause the TC's will be or are now getting more scrutiny while the lending regulations are getting revised.

What business, any business, has legislation that guarantees

they get paid? There is a risk factor in any business.

Risk is not the same as a pattern of fraud we're dealing

with. I, as a NP, can have complaint(s) lodged against me w/the SOS. From what I can determine, the SS, on the other hand, have no oversight. The TC's have the State Insurance Commission (I think) to answer to. But as the independent contractors working for SS's--we're pretty much on our own. I think ANY close look at the SS position in the residential loan process will benefit us. This has been discussed frequently, but I think that day is getting closer b'cause it appears there are so many SS just taking the money lately. I would not be surprised to learn that the states of CA and FL are examining the SS capacity already, looking towards stricter licensing, or whatever. CA has so many rules, there are rules about the rules...or laws w/laws about the laws. Love to visit! Best traffic-control of anywhere!

Re: Risk is not the same as a pattern of fraud we're dealing

I don't think most of our law makers have a clue that this business even exists. Most of the general public doesn't know this business exists. For them, notaries are people that do car titles.
Probably need to start educating the legislators at the state level in regards to what our special issues are and ask for assistance.

Robert
what would you like me to say to my representative in the House regarding the signing agent business?? I would be happy to talk to him.

(oops--wasn't finished) don't know Dodd Frank Act

affects us, but most of the industry now requires licensing. NSA's have been operating "under the radar" for a long time. Many states require a TPL, and some cos. have requested it for VA. It's a complicated & expensive process, and doesn't really fit the bill for NSA's, but it's all we currently have.
I won't get into this too deep, because it would cross over into Just Politics, but I still can't understand why Americans continue to want the gov. (city, state or federal) to take care of them but then want to scream that we're headed for socialism.
The only way I know of to avoid bad cos. & collections is to be diligent in who you accept work from. Everyone, including drs. & hospitals, has collection issues. They have us sign forms for payment guarantee. How would they know who is a bad risk & who isn't? This is a really loaded issue when you come down to it.

Totally agree with Marilynn . Do you want mandatory

training, testing, record keeping, procedures, etc, etc. ???
No one forces a NSA to accept a job. If you don't get paid , then sue, write nasty letters, send
out a hit man (JK) or do whatever. Don't ask your state or federal legislators to bail out your bad
decisions, or outcome, and then have them to proceed to tell you how to run your business and your life.

Seems clear that the only thing we can do collectively is stay away from the fraudsters. If no one works for them we won't get stiffed.

Can we get on board with this concept?

That's why Signing Central is such a great feature of this

site. :-) It's only as good as we make it though.

Each NSA must determine who to work with and stay away

from companies that do not pay or take forever to pay.
It has always been my belief that two different Signing Agents can work for the same company and one will be paid very quickly - the other may not be paid at all.

Each NSA must make decisions for his/her business.

HVR Notaries management is trying to resolve this problem as soon as possible. We totally understand your frustration when calls are not being returned or for late payments. We stopped taking orders from clients until we fix this. We will contact everyone within next week in regards compensation. There is a lot of false and inaccurate information on this blogs but we can assure you that we will not hide and we will do the right and ethical thing! No one is collecting money to get richer or walking away like other companies have. We will make things right but we ask to give us time. Also Mark Wills and JJ have no relationship with HVR nor does HVR have something to do with the classes mentioned above. Thank you and we apologize for the late response.
