Witness

Not sure if this has been asked before, but if so, please direct me to the message. I could not find anything in my search.
Ok, get docs from Title company., Instructions state for me the Notary to sign as a witness on the mortgage.
I do not believe that I can do this. I am in New Jersey & this is a New Jersey property so Witness's are not required.
Your thoughts?
Thanks
Walt

Some lenders want witnesses. Sorta like some guys wear suspenders and belt. Why not?

Ok unless your state does not allow you to be a witness (?)

I get this a lot in MO/KS. Neither state requires a witness, but some lenders want them anyway and I am allowed to be a witness as long as I don't end up notarizing myself as a witness, so I make them happy and sign as a witness. No big deal.

It is against the law in AZ for the notary to also act as a witness.

One problem I see is that some organizations never update their mortgage documents or instructions. Their people know full well that Vermont eliminated the witness requirement in 2004. but their mortgage and instructions have never been updated. You might want to check with a real live person.
