"Who Aquired Title As"

On a Mortgage Section "B" Borrower is: Joseph Borrower and his wife Jill A. Borrower who aquired title as Jill Ann Borrower. Signature Page "By Signing Below" only has pre-printed Joseph Borrower and Jill A. Borrower on two seperate lines. Question: How would Jill A. Borrower sign?

You need to ask title, but when this happens to me, they tell me that "Jill A. Borrower" signs (and is I.D'd.)

Check with the hiring entity. I imagine the person who is authorized to figure out the answer will want to know what state the property is in, because the way mortgages are worded to handle name problems varies from state to state.

You can check with the hiring party, but normally you

have them sign their name as it is printed below the signature line. Just because that's
mentioned in the other verbage, doesn't mean she's supposed to sign that way.
It sounds like the loan docs are drawn up for Jill A. Borrower and you have her sign that way.
We don't make decisions about such things.

I have worked with mortgages forever here in Michigan and it has always been signed (in this case) Jill A. Borrower. However, I had a signing the other evening that required the mortgage to be signed both with Middle initial and with middle name. Even though they had typed in only the one. A seperate email instructed me to have the borrower sign the Mortgage twice and initial the names on the front page of the mortgage.....
Never so such a mess IMO....It was already noted that she was known by both and ID was
provided....why mark the legal document up so much.

PS////without the specific instructions from the title co, I would have only had the borrower sign as Printed and only once.

Thanks All, I had this and proceeded exactly as mentioned. I had Jill A. Borrower only sign as pre-typed and did not add w/a/t/a/ Jill Ann Borrower. I was not instructed to add such prior to signing either. I now have to return and have Jill Ann Borrower sign after title has added w/a/t/a/ Jill Ann Borrower. This is not a problem at all and I am happy to return to correct but I just wanted some colleague's opinions on their course of actions.

As for charging to go out again, you don't say if you tried to contact the hiring entity about how the signer should sign. If you tried and didn't get through, or if you tried and were instructed to have her sign only as Jill A. Borrower, you should definitely be changing to go back out. If you didn't try, then it's debatable.

As far as whether it was necessary to have her add another signature with her middle name, that's not really a notary's call. The people who decide that will be looking at:

1. The standards in the state where the property is located to obtain title insurance.

2. The requirements of those who buy existing mortgages, which are sometimes stricter than the state title insurance requirements.

When in doubt why not do both ways?

...and put a sticky note on the 2nd version saying to please shred whichever version is not needed. I have never had any company take issue with my doing this, and it has cut down on the amount of times I need to call to find out how to do something.

Most times my 2nd version is what I am used to doing, but sometimes it is just my instinct kicking in and saying the way they have it doesn't seem right, and the first version is how they have it set up to do, but since I never get any negative or positive feedback by doing this I never find out which one they end up using. I have my suspicions that my version was ultimately used at least most of the time, and they just don't want to admit that I was right, but I guess I will never know for certain.
