While I agree that the comment was inappropriate, I didn't get the sense that Jan meant it seriously.

This is not correct. The First Amendment only applies to what the government can do - it does not apply to a privately-owned web site such as this, even if it is open to the public. The owner of the website is the one who gets to decide what is and isn't allowed, and we don't get to appeal that decision.
An example of this is Twitter, which will suspend or ban users for making threats of violence, because that violates their Terms of Service. Not because it might be illegal, not because it isn't protected speech, but because they don't want that type of speech on their platform. Other platforms turn a blind eye to it. |
