The only time you get arrested without an indictment (in NYC, at least) is when you are caught in the act of committing a crime. Even then, the case goes before a Grand Jury if the DA decides to prosecute. I don't know how things work in your state.
Grand juries in NYC might handle dozens of cases during the two weeks they usually sit. Bragg empaneled a Special Grand Jury to consider only this case and nothing else. The rules for Special Grand Juries are different. SGJs in NYC can sit for a long time (months), but they only meet two or three times a week, and usually only for a half-day. This SGJ meets on Mondays and Wednesdays, which is why I said it would be Wednesday at the earliest; more likely, it won't be before next week because as of Monday they were still hearing testimony. At this point, the DA hasn't even asked for an indictment - if he had, he wouldn't need the additional witnesses. It's possible that they will meet tomorrow, vote out an indictment, and then Trump has to be made aware to give him an opportunity to surrender himself (that's just a courtesy, not a requirement), which would make Thursday the earliest time for his arrest. It's also possible that the GJ does not vote out a true bill, in which case he walks.
Another possibility is that the SGJ already voted out a True Bill, and the DA decided to keep it under seal. Not likely here, since the SGJ is still hearing testimony.
I'm not yet convinced there will be an indictment; I was just making the point that Trump created the rumor himself and is using it to raise money. There was never any truth to it, but of course the media jumped all over it, just as he knew they would. He never stops grifting, and they never learn that they're being used in his grift. |
