She led with "making fun of" and then added "making threats". It's the latter that's the problem. When she said they would shut them down, I took it to mean by using the laws that currently exist - not by creating new laws. She said "they should be prosecuted" - that implies there's something to prosecute them for. You can't create a new law and then prosecute someone who violated it before the law was passed - that's specifically prohibited in the Constitution.
