What is the reason one signer does not have current ID? I always ask that question because the credible witnesses have to take an oath that it is "difficult or impossible for the person to obtain ID". If the signer just hasn't bothered to renew the ID, then that is not difficult or impossible. It maybe inconvenient and annoying, but not difficult or impossible, therefore, the oath of the credible witnesses would be a LIE.
Sometimes the person cannot renew because they have racked up a bunch of tickets they cannot pay and the DMV holds the license/state ID renewal hostage until those tickets/penalties/fees are paid in full.
Too much identity theft and fraud these days for the signer to not present current, gov't issued ID.....and you're dealing with a real property transaction. |
