VA says signing it's just fine for the signer to be physically located in another state. What isn't so clear is what the states where the signers are physically located think about this. From what I've read, the VA remote eNotaries give VA as the venue, so when the document shows up at a land record office in some other state, it isn't apparent from the face of the document that the notary and the signer were physically separated.
I've read that a few of the states that have just passed remote enotarization will require their notaries to include in the certificate that it was a remote enotarization. (These laws haven't gone into effect yet.) |
